The Complaint

Charter used an automatic telephone dialing system to make these calls without consent. The calls were made despite the numbers being on the National Do-Not-Call Registry. The lawsuit challenges all calls made from November 24, 2016, to the date of filing.
Charter Communications is a major provider of cable, telephone, and internet services. They promoted their services through unlawful telemarketing campaigns. On January 10, 2020, Henderson received a call from Charter, despite being on the Do-Not-Call list since 2010. Charter’s robocalls used an automatic dialing system, evidenced by silence and a clicking sound before connecting to a live agent. Henderson received multiple calls, all violating the TCPA.
Henderson aims to represent a class of individuals who received similar unsolicited calls. He highlights his own experience of receiving repeated unwanted calls. Despite informing Charter of the Do-Not-Call list, the calls continued. Other consumers experienced similar harassment and privacy invasion.
Claims for Relief
Henderson seeks several forms of relief: an injunction to prevent further violations, statutory damages for each unwanted call, punitive damages for willful violations, attorneys’ fees, costs, and any other appropriate relief. He also demands a jury trial for all counts in the complaint. The relief aims to compensate affected individuals and enforce stricter telemarketing practices. Henderson hopes to set a precedent for better consumer protection.
