Hageman et al. v. Hyundai Motor America Case Information
- Case Number: 8:23-cv-01045
- Case Status: Case is Ongoing
- Court: United States District Court, Central District of California
- Filed: June 14, 2023
Lemberg Law filed a lawsuit against Hyundai Motor America on behalf of a putative class, alleging that 2020–2022 Hyundai Palisade vehicles are equipped with defective tow hitch wiring harness modules. The defect increases the risk of vehicle fires, rendering the vehicles’ towing capabilities unusable and creating safety hazards. Plaintiffs seek relief under state and federal laws, including claims for breach of warranty, unjust enrichment, and diminished vehicle value.
Complaint
The Complaint alleges that Hyundai knowingly sold vehicles with a defective tow hitch wiring harness module prone to electrical short circuits, which can result in fires. Hyundai’s failure to address the defect in a timely and adequate manner has caused significant inconvenience, financial losses, and safety concerns for vehicle owners.
Examples Include:
- Fire Risks: Fires have occurred due to debris and moisture causing short circuits in the tow hitch module.
- Disabled Towing Ability: Hyundai’s interim fix removed the fuse, disabling towing features.
- Delayed Repairs: Replacement parts have been unavailable, leaving owners without solutions for long periods.
Manufacturer Response
Hyundai recalled 245,000 vehicles in August 2022 but did not address the defect. The interim patch removed critical towing functions. A permanent fix announced in May 2023 has been delayed due to insufficient replacement parts.
Claims for Relief
The plaintiffs are demanding:
- Free Repairs: Functional and defect-free tow hitch wiring harness modules provided at no cost to owners or lessees.
- Compensation: Reimbursement for out-of-pocket expenses related to repairs, diminished vehicle value, and loss of use damages.
- Injunctive Relief: A mandate for Hyundai to issue transparent communications and expedite repairs.
- Punitive Damages: For knowingly selling defective vehicles and failing to provide timely remedies.
The lawsuit also seeks compensation for diminished vehicle value caused by the safety risks and loss of critical functionality.
