Complaint
The complaint alleges that Quten’s magnesium supplements cannot physically contain the advertised magnesium amount due to the following:
- Capsule Capacity Limits:
- Quten uses size 00 capsules, which hold a maximum of 1,092 mg of powder each. Two capsules can fit no more than 2,184 mg of powder.
- Magnesium glycinate consists of only 14.1% elemental magnesium, meaning approximately 3,000 mg of magnesium glycinate is needed to yield 420 mg of elemental magnesium. This exceeds the physical capacity of the capsules.
- False Advertising:
- The front and back labels of the supplements prominently claim 420 mg of magnesium “as Magnesium Glycinate” per serving, which plaintiffs argue is impossible given the above facts.
- The supplement also contains other ingredients, such as gelatin and magnesium stearate, further reducing the available space for magnesium glycinate.
- Inferior Ingredients:
- Plaintiffs suspect the supplements contain magnesium from cheaper, less absorbable sources, such as magnesium oxide, instead of magnesium glycinate.
- Capsule Capacity Limits:

Quten denies the allegations, arguing the claims are based on a “lack of substantiation” rather than affirmative evidence of falsity. However, plaintiffs counter that the claims are rooted in the mathematical impossibility of the stated magnesium content.
Relief Sought
The plaintiffs and the class members are seeking:
- Compensation: Refunds for purchases, along with damages for misleading advertisements and breach of warranty.
- Injunctive Relief: A cessation of false advertising practices (withdrawn during the proceedings).
