Noel Benadom, brings this class action lawsuit against Quest Diagnostics Inc. and Optum360 LLC. Benadom claims Quest Diagnostics failed to protect confidential information. He seeks damages and an injunction to stop these practices.
The Complaint
Plaintiff Noel Benadom filed a Class Action Complaint against Quest Diagnostics Inc. and Optum360 LLC. Benadom alleges that Quest and Optum360 failed to protect confidential information of millions of consumers, including Personally Identifiable Information (PII) and Protected Health Information (PHI). Despite Quest’s promises to safeguard this information, a data breach occurred due to inadequate security measures at their billing collections vendor, AMCA. The breach exposed sensitive information to unauthorized access.
Quest Diagnostics is a major provider of diagnostic information services. They partnered with Optum360 for billing services, and AMCA provided collections services. On June 3, 2019, Quest announced that customers’ sensitive information was accessed by unauthorized parties between August 1, 2018, and March 30, 2019. This breach affected 11.9 million customers. The compromised information included names, social security numbers, dates of birth, and financial information.
Benadom aims to represent a class of individuals whose information was compromised in this breach. He highlights the steps he took to protect his information and the impact of the breach on him and others. Despite efforts to secure his data, Benadom experienced fraud attempts. The class action seeks to address the widespread impact on affected individuals.
Claims for Relief
Benadom seeks several forms of relief: an injunction to prevent further violations, statutory damages for each compromised record, punitive damages for willful violations, attorneys’ fees, costs, and any other appropriate relief. He also demands a jury trial for all counts in the complaint.
