srtcpasettlement – In lawsuits filed across the country, consumers allege that Sunrun Inc. violated the Telephone Consumer Protection Act (TCPA) by placing telemarketing calls to wireless phone numbers without the recipients’ prior express written consent.

What is the Loftus et al. v. Sunrun Inc. TCPA Class Action Settlement?

A $5.5 settlement has been reached in a class action lawsuit alleging Sunrun Inc. violated the Telephone Consumer Protection Act by using an automatic telephone dialing system to call consumers who were on the National Do Not Call Registry with pre-recorded messages. The Loftus class alleged Sunrun repeatedly relied on millions of robocalls as part of its marketing strategy.

Sunrun Inc. denies any wrongdoing but has agreed to settle the class action lawsuit in the best interest of all parties.

The Settlement affects each of the millions of members of the nationwide class, which includes anyone who received a call from Sunrun Inc. using an auto-dialing system or an artificial or prerecorded voice.

If the Settlement is approved, affected Class Members will be eligible to receive pro rata share of the $5.5 million settlement fund which divided among all members could equate to a monetary award far more inferior than what filing an individual suit could result in.

After attorneys’ fees and expenses and lead plaintiffs’ incentive awards are deducted, remaining eligible persons would receive an estimated cash award of only $57 based on a 10% claim rate, and could be less upon final approval.
