Navy Federal Credit Union Class Action

Munday vs. Navy Federal Credit Union (U.S. District Court, Central District of California, Case No. 8:15-cv-01629)

In a class action complaint, Lemberg Law is representing Ronald Munday, who is suing Navy Federal Credit Union for alleged violations of the federal Telephone Consumer Protection Act (TCPA). The complaint alleges that Navy Federal Credit Union robocalled Mr. Munday’s cell phone.

The complaint alleges that, around February 2015, Navy Federal Credit Union used an automatic telephone dialing system (ATDS) to robocall Mr. Munday’s cell phone. When he answered the calls, Mr. Munday heard a period of silence before an NFCU representative came on the line. That period of silence is one clue that NDFCU used an ATDS.

The representatives from Navy Federal Credit Union indicated that they were calling for someone else, a person that Mr. Munday didn’t know. Although our client repeatedly asked Navy Federal Credit Union to stop calling, the calls kept coming.

Because Navy Federal Credit Union used an ATDS and didn’t have our client’s express written consent to robocall his cell phone, the suit alleges that calls were violations of the TCPA.

The complaint proposes the following two classes: 1) People in the U.S. who received Navy Federal Credit Union cell phone robocalls between October 2011 and October 2015, and who didn’t provide prior express consent; and 2) People in the U.S. who received Navy Federal Credit Union cell phone robocalls between October 2011 and October 2015, and who asked NFCU to stop calling.

Update: Final settlement approval has been granted. The settlement administrator is disbursing checks to valid and approved claimants in September 2017.
