Were You Harmed By False Information or Errors In Your IntegraScan Report?

You may have a claim if a background check error cost you a job

The results of an employment background check can determine whether or not you get hired or promoted. Some employment background checks skim the surface, while others dig deep. Your background check may simply verify your social security number and immigration status. On the other hand, it could dig into your social media presence, your criminal history, and your credit history. An employment background check may also include information about your character and reputation, as reported by friends and neighbors.

Whatever the scope of the background check, the Fair Credit Reporting Act (FCRA) sets strict standards for how employers and background check companies get consent for and conduct background checks. It also covers what a potential employer can and can’t do with the information they find.

If IntegraScan or another background check company doesn’t meet the standards outlined by the Fair Credit Reporting Act, the law gives you the right to fight back.

If you feel you have been harmed by this IntegraScan, click 844-685-9200 ☎ NOW to call us or complete out our free case evaluation form. We will fight for your rights. Our services are absolutely FREE to you.

What are my Background Check Disclosure and Consent Rights?

A Summary of Your Rights Under the FCRA

It’s important to understand that, when it comes to employment background checks, you have rights. According to the Fair Credit Reporting Act, you must give an employer permission in writing to conduct a background check. If you do give them permission, and then they deny you employment because of something contained in your background check, the law says that they must tell you so and provide you a copy of your rights under the FCRA.

In fact, in order to obtain a background check company from IntegraScan, the employer must certify that a) they’ve given you a standalone document that indicates the employer may conduct a background check; b) that you have given your permission for them to obtain a background check; and c) if they take an adverse action based on your credit report, they will give you a copy and notify you of your FCRA rights.

Your Right to a Mistake-Free and Legally-Compliant Report From IntegraScan

Under the law, IntegraScan is required to take reasonable steps to ensure its report is as accurate as possible.

The Fair Credit Reporting Act limits the kinds of negative information a background check report can include. For example, a background report can’t list old items, such as civil suits, judgments, arrest records, paid tax liens, and debt collection accounts that are more than seven years old. It can’t list a bankruptcy that is more than 10 years old. The only type of old item a background report can list is a criminal conviction – but not a conviction that has been expunged.

Your Right to Dispute Discrepancies on an Inaccurate Report from IntegraScan

If you weren’t hired or promoted because of your background check, the employer is required to provide you with a copy of the report. If you believe any of the information contained in your report is incorrect, you have the right to file a dispute with the background check company.

When you dispute a report, there is a 30-day window for the background check company to investigate and correct any errors.

Your Right to Sue IntegraScan if Your Report Includes Mistakes, Inaccurate, or Illegal Info

Losing out on a job because of a shoddy background check costs time and money. If this happened to you, you may be able to sue in federal court. If you sue and win, you may be entitled to actual damages, or to statutory damages up to $1,000. You may also receive punitive damages, attorney fees, and court costs.

Complaints Against IntegraScan

Job opportunities are hard to come by. If you’ve lost an opportunity because your employment background check was inaccurate, you should know that others just like you have sued companies like IntegraScan for Fair Credit Reporting Act violations.

Sometimes, those lawsuits accuse the background check company of being sloppy, and not taking the time to ensure that their work is accurate. Others allege that the company falsely listed felony convictions, including expunged, outdated, or incorrect information. Still other complaints allege inaccurate educational, work, driving, credit or other personal information harmed the person’s chances of getting a job. Finally, cases have been brought that accuse the company of improperly handling disputes brought by consumers.
