Krejci vs. Cavalry Portfolio Services, LLC (U.S. District Court, Southern District of California, Case No. 3:16-cv-00211)
In a class action complaint, Lemberg Law is representing Kevin Krejci, who is suing Cavalry Portfolio Services, LLC for alleged violations of the Telephone Consumer Protection Act (TCPA). The complaint alleges that Cavalry Portfolio Services robocalled Mr. Krejci’s cell phone without his consent.
Cavalry Portfolio Services is a debt collector that is in the business of collecting old debts. Mr. Krejci says that Cavalry Portfolio Services called him on his cell phone. When he answered the calls, he heard a period of silence, then an electronic clicking or beeping. After that, the call was routed to a Cavalry Portfolio Services employee. The silence followed by electronic sounds is indicative of an automated telephone dialing system, which is regulated under the TCPA.
Although Mr. Krejci told Cavalry Portfolio Services to stop calling his cell phone, he says that the debt collection agency continued to do so.
The proposed class of people represented are those in the U.S. who, between January 27, 2012 and January 27, 2016, received a cell phone robocall from Cavalry Portfolio Services.
