What is Torres Credit Services – TCS?

Torres Credit Services or TCS is a third-party collection agency based in Pennsylvania. TCS has received consumer complaints alleging violations of the Fair Debt Collection Practices Act (FDCPA) such as failing to verify debt and attempting to collect debts not owed. If you have been contacted by Torres Credit Services, make sure you understand your rights before responding.

According to the Better Business Bureau (BBB), Torres Credit Services was founded in 2003. The BBB established its profile page in 2005. TCS is listed as a collection agency. Buzzfile estimates TCS’ annual revenue at $1.9million, and the sizeof its headquarters staff at 8 people.

According to its website, TCS “provides its clients with world class accounts receivable management and unparalleled call center capabilities.” The TCS website does not provide any detailed information about its business practices. Instead, it describes TCS as “a leader in the credit, collections, and call center arenas” with “more than 50 years management experience in collecting receivables throughout the United States.”

As for compliance, Torres Credit Services cites its SSAE 16 Type II and PCI DSS certifications.  TCS is also a “Nationally Certified Minority Enterprise (NMSDC) that welcomes diversity in the workforce and provides a strong work ethic to achieve all client goals and objectives.”

Torres Credit Services has worked “with some of the largest utility companies in the country and has handled a diverse range of products and services for many years.” Their Client list includes residential and commercial utility, electric/gas, banking, medical, and retail business.

The Torres Credit Services website does not provide any links or references to consumer protection resources, laws, or enforcement agencies.

How many complaints are there against Torres Credit Services – TCS?

The BBB has closed 26 complaints against Torres Credit Services in the past three years, with 9 closed in the past 12 months. Almost all of those complaints allege problems with billing and collections. Since May 2015, the Consumer Financial Protection Bureau (CFPB) has received 13 complaints about TCS. Justia lists at least 7 cases of civil litigation involving TCS.

Complaints against Torres Credit Services frequently cite problems resulting from inaccurate information reported to the credit reporting agencies (CRAs). In June 2016, a complainant reported that he had discovered inaccurate information on his credit report. He tried to contact TCS, but could not reach anyone. He contacted the original creditor, and they told him there was no record of an outstanding balance.

In May 2016, a complainant indicated he had discovered on his credit report a collection item for $1,200.23 for an outstanding utility bill. The complainant contacted TCS, who told him they did not have any information regarding the account, and that the utility company in question was not one of their clients. Regardless, the complainant subsequently received a letter from TCS stating he owed $1,200.23. This letter represented the first contact Torres Credit Services had ever initiated with him. The complainant researched the matter further and discovered there was another person with a similar name to whom the debt may have belonged, but it had already been reported on his credit reports.

In February 2017, a complainant had closed a utility account, but found there was an outstanding balance reported on his credit report. He contacted TCS, paid the remaining amount due, informed them he had never been notified of the outstanding balance, and requested that they remove the item from his credit. After 3 months and 3 additional phone calls, his credit report still reflected the delinquency, so he contacted TCS again and was told “they never removed negative credit reports, that there was no supervisor the complainant could speak with, and that in fact they don’t forward calls to anyone for any reason and then hung up.”

In all three complaints, TCS’ responses begin with the statement, “Torres Credit Services, Inc. (hereafter ‘TCS’) …is a Pennsylvania Corporation conducting business as a licensed collection agency in various jurisdictions. Torres Credit Services is not a telemarketer and performs no activities whatsoever which fall within the… purview of the Telemarketer Registration Act, 73 P.S. S 2241 (2005), et seq., (hereinafter ‘the Act.’).As you know, under the Act, ‘a telephone solicitation call does not include a call made to a residential or wireless telephone Consumer… (2) in reference to an existing debt, contract, payment or performance.’” In all three cases, TCS provides resolution by stating that “Torres Credit Services discontinued collection of the account, requested deletion of its trade line from all credit reports and closed its file.”
