What is the Lemon Law in Alabama?

In the state of Alabama, if your vehicle is determined to be a lemon, you are entitled to a refund of your money minus a deduction for mileage from the mileage at the first repair, and the manufacturer also pays off your loan, and you return the vehicle to the manufacturer. Or in the alternative, you’re entitled to a replacement vehicle. You’d be entitled to a new vehicle in place of your current vehicle, and there’s also the possibility of cash compensation where you keep your vehicle. In all of those instances, the manufacturer’s required to pay the attorney’s fees as well.

What vehicles Are Covered Under the Alabama Lemon Law?

Alabama Lemon law covers new passenger vehicles, SUVs, vans, trucks, and motorcycles that are purchased in Alabama within two years or 24,000 miles of the original delivery date of the vehicle (whichever comes first) and that have a manufacturer’s gross vehicle weight rating of under 10,000 pounds. In order to be considered a “lemon,” the vehicle must meet the following requirements:

  • Does not conform to the manufacturer’s express warranty
  • Has substantial defects affecting the use, safety, or value of the vehicle
  • Has manufacturer’s defects that first occurred during the first year after the original owner’s delivery date or the first 12,000 miles on the odometer (whichever period ends first)
  • The problem was not a result of modifications made to the vehicle
  • It is mostly driven for personal, family, or household use
  • It has been taken in three times for the same problem or has been out of service for 30 business days for the same problem
  • The manufacturer has had a final opportunity to repair the vehicle
  • It was taken in for its first repair attempt before the first year or 12,000 miles; was taken in for its final repair before two years from the original delivery date or the first 24,000 miles on the odometer (whichever period ends first)

The Code of Alabama 1975, Title 8, Chapter 20A, Sections 1-6 is the state’s Lemon law.

Does the Alabama Lemon Law apply to used cars?

Typically a vehicle that is purchased used may still qualify as a lemon if it was purchased and the problems occurred while the vehicle was still under the manufacturers new car warranty or possibly covered by a certified pre-owned warranty or extended warranty. Finally it should be noted that a used vehicle that is purchased as is and without a warranty cannot qualify as a lemon under the AL Lemon Law.

Alabama lemon law provides several options for a successful lemon law claimant. First, you may be awarded a replacement vehicle of the same year, make, and model. You may also qualify for a monetary award, which can include:

  • The full contract price
  • Charges for undercoating
  • Dealer preparation and transportation charges
  • Sales tax
  • License and registration fees
  • Finance charges paid on your loan after you notified the manufacturer of the problem
  • Vehicle rental costs
  • Attorney fees

The amount of the monetary reward may be reduced by a deduction for the total mileage on the vehicle. This amount is calculated by dividing the total contract price by 100,000 and multiplying that amount by the mileage driven since delivery.

Pursuing a AL Lemon Law Claim

Under Alabama lemon law, before you file a lemon law claim, you must first send a demand letter to the automaker via certified mail outlining the problem. See an example of a demand letter that you can adapt and mail yourself.

Once you send the letter, the manufacturer or dealer has seven days to tell you where to take your vehicle for repair, and then has 14 days to repair the vehicle once you have taken it in for repair.

If your vehicle still isn’t fixed, you must participate in the manufacturer’s dispute resolution process (for example, arbitration, conciliation, or mediation) before you are eligible to file a lemon law claim.
