Can MRS Associates Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely MRS would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. Can you help me file a No Fee Lawsuit against MRS Associates?

Absolutely.  You can sue a debt collector. Here is a Sample Case Filed in Federal Court

In 2013, a magistrate judge in U.S. District Court, Middle District of Florida, granted partial summary judgment to the consumer in Dauval vs. MRS BPO for alleged violations of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act. According to the magistrate judge’s decision, the undisputed facts were that Chase Bank hired MRS BPO to collect a credit card debt from the consumer, and MRS Associates called the consumer’s workplace more than 23 times. During three of the calls, the debt collector spoke to a person. The first two times, the debt collectors left messages with a reference number. Then, the consumer called and told MRS Associates not to call him at work because he could get fired. The debt collector noted on his record not to call his work. Then another of the agency’s debt collectors called the consumer’s work and left a message. The consumer again called and said he couldn’t get phone calls at work, and that he was filing for bankruptcy. The debt collector removed his work number so that he couldn’t be called there again. The consumer alleged that the debt collector told him the calls would continue until he provided her bankruptcy information. The court determined that MRS Associates had violated provisions of the FCCPA and the FDCPA, and granted partial summary judgment.

MRS Associates BPO Calling You?

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

MRS BPO is calling my father (cosigner) on my private student loans and intimidating him. They called me and asked for my dad this week (after already speaking to him once) and the rep told me we “are in a very dangerous situation” and I said NO we are not, its debt not a death sentence, and I told him to stop trying to scare my dad. He told me they are not going after me, only him, I said I am an equal party and he didnt care, I said to only call me from now on he refuses. I told my dad to stop talking to them — I told him I will file CH13 and he said “that wont help your dad at all” and I said “you will not get a lift of stay on this for him and you know it” and he admitted he is not an attorney. I think the lies that a CH13 on a C1 wont help a C2 are absurd, he is trying to scare an old retired man on a fixed income. Hopefully I get a 5 year plan and shut him up. I dont know how he can justify saying I am in a dangerous situation, its not like he will come beat me up.

Got MRS calling me non stop. 2 or 3 times a day !!

I received a post card from MRS BPO claiming that I owed a debt of $810.21 for an unpaid Direct TV service. I called immediately and explained that I have never had Direct TV service. I asked the person on the phone the address and the dates of the service. The dates of the service we after I moved from the address that Direct TV had registered for the service dates. Therefore, either someone else is using my name to sign up for service, or MRS BPO is making up a charge to see if the can collect from a vunerable senior citizen. Furthermore, I called Direct TV and found that they had no record of service under my phone number.

I received one text and one missed call from them. In both cases I called back and have told them that I will not provide any of my PII to them and for them to provide me with any information on their claim and I will either confirm or let them know that I am not the party they are seeking. They refuse to do that and keep asking for my name. I requested that they do not call or text my number anymore. Hopefully they will no longer contact me.

MRSBPO LLC is harassing about a debt($334.28) that I’ve already paid to the previous D.C.A.
The previous debt collector confirmed that YES I did pay the amount in full and have a $0 balance due.
I even have conformation number from D.C.A..

When I call BPO LLC they wont give me the information to help me, nor listen to what I tell them. When confronted with evidence that I paid, they say I need to call the company that told me to call BPO LLC in the first place.

I need MRS BPO LLC. to reimburse me for monies lost due to lost time at work because of their constant nonstop phone calls. they always call from a different number so I always answer incase of emergency..

My time is very valuable. time is money.
