Understanding Your Debt Collection Rights

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

But here’s the rub: If you want to enforce your rights, or recover money for violations — you need to sue. These laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

What Our Clients are Saying

“Every e-mail sent or phone call made to your firm was answered not only promptly, but virtually immediately. Mr. Hirnyk patiently explained every legal concept – including what was possible and what was not – under existing state and federal consumer law.”

“You were very professional and helpful…. For once I didn’t feel like I was alone in the battle. I received a check from your company – and that was amazing in itself – but also the debt collector is no longer on my back. It feels like a weight has been lifted off my shoulders.”

NCC is known for trying to collect debt without sending initial collection letters and they often make false deals, I have an apartment debt they have been trying to collect on that I know I don’t owe money for and I have proof, I sent them 2 debt verification letters and they sent an account ledger that has all kinds of inaccurate charges but they have failed to show proof of what they are trying to collect. I plan on taking them to court soon cuz I’m not paying them anything…

I wouldn’t sent this company a dime of my money without them sending me some legitimate paperwork…… Send them a Pay-and Delete agreement, and don’t send any money without receiving something in writing from this company with their Letterhead and a signature from an authorized collections Manager.

Harassment by ncc and possible illegal eviction proceeding. They never served me a court notice, but i see it on my credit report now

My concern is that the over $2,000 they are saying i owe is from an “auto loan” that i never even attempted to acquire.

I have NCC Business on my credit report and I am unable to get in contact with a representative. I am inquiring on how can I removed them from my credit report but no one is willing to help me out

NCC Business just contacted me at work and I am losing it. I am wondering how and who provided them with my office number. I was not at my desk therefore they left a voicemail. What are my rights?
