Is Professional Recovery Consultants a scam?

They’re legit. According to the Better Business Bureau (BBB), Professional Recovery Consultants, Inc. was founded and incorporated in 1979. The BBB established a profile page for PRC in 1988. The BBB lists Professional Recovery Consultants as a collection agency with an estimated 100 employees and uses the alternate business name, G.S. Miller & Associates. Buzzfile also estimates size of PRC’s headquarters staff at 100 employees, with its annual revenue estimated at $12.5 million.

According to its website, PRC “has…grown to become the region’s premier provider of fast, efficient, and hassle-free debt recovery and accounts receivable services. This growth has been a direct result of PRC’s concentration on client service, while remaining on the cutting edge of new technology and collection technique development.”

Who does Professional Recovery Consultants collect for?

Professional Recovery Consultants collects delinquent debts for a variety of businesses and industries, including medical and healthcare service providers; banks, credit unions, and financial services companies; consumer retail lenders; government agencies; utility service providers; education lenders; and commercial business-to-business accounts.

As a full-service collection agency, PRC offers a wide range of services, including primary, secondary, and tertiary bad debt collections; payment plan monitoring services; letter campaigns; courtesy call campaigns; skip tracing programs; clean-up programs; credit bureau reporting; trigger reporting through the credit bureaus; settlement campaigns; and pre-service calls. In addition, PRC’s healthcare division offers early-out, self-pay collections for true self pay accounts and BAI accounts; insurance verification services; insurance follow-up programs; patient satisfaction surveys; and patient financing. PRC’s education division also offers service for tuition; institutional loans; and book store and room and board fees.

PRC cites compliance with Professional Practices Management System (PPMS). PPMS certification is “based on compliance through implementing and adhering to the industry’s highest level of professional practices and policies.” PRC states that its “collectors must utilize non-alienating communication techniques to achieve payment.” The PRC resources page includes links to the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). However, there is no detailed information about consumer protection laws such as the FDCPA.

Absolutely.  You can sue a debt collector. Here is a Sample Complaint:

Complaints against Professional Recovery Consultants cite problems resulting from disputes about the validity of debts and allegations of harassment. In November 2017, a complainant stated that PRC had contacted him repeatedly for delinquent medical bills he claimed not to owe. According to the complainant, PRC had called him several times but refused to identify themselves or the purpose of their call. He stated that the “calls are harassing and come from a machine and not a real person.” He indicated that PRC had left automated messages for him that “say something like, ‘Is this complainant’s name? If this is complainant press 1. This call is being recorded,’ etc.” The complainant stated that he had been “right by the phone when the call came in… around 9 am. However, PRC also called the previous night at 9 pm when he was getting ready for bed.” When he returned the call, he was allegedly “patched in to talk to a live person…who identified as being with PRC.” When the complainant “asked about the nature of the call, the PRC representative wouldn’t tell him.” The complainant was recovering from knee surgery and was “involved with several health providers,” so he asked if the call had to do with healthcare, but the PRC representative did not answer. The complainant was “getting annoyed with the guessing game, so he asked for the nature of the call.” Allegedly, the PRC representative“said ‘personal’ and referred him to the” website. When the complainant discovered that PRC is a debt collection agency, he “called his providers and found out that he didn’t owe any money.” The complainant expressed his concern that PRC had his social security number and “was ticked off by their ambivalence…and that he wasted 2 hours trying to figure this out.”

In July 2016, a complainant alleged that Professional Recovery Consultants was attempting to collect a “false debt” and was “causing undue stress and using unlawful collection tactics.” According to the complainant, he had “received a letter stating that he owed back taxes from a job he worked at many, many years ago” at which the employer “did not take enough money from his… check for… state taxes.” Allegedly, PRC claimed that he now owed a large sum. However, the complainant stated that “this has not been validated and that he never received anything from anyone else and had never been contacted before.” He also stated that he had “paid almost $1,000.00 to them and had been threatened by them.” The complainant was 71 years old and had been “diagnosed with heart issues brought on by this” collection effort. He requested “validation of this debt in writing and…a cease and desist on all verbal communication.” He acknowledged that he “should have questioned this from the start, but he was extremely scared.” He also restated his belief that the collection effort was fraudulent, and that he had found “no record with the…State Department of Revenue.” He requested that PRC send “all of his money back in certified funds,” and demanded “a written apology for the way he had been treated.” He “also wants something done so this company will stop doing this to senior citizens,” citing multiple similar complaints from others like him.

Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).
