What Does a Lawsuit Against Midland Credit Management Look Like?

Here is a sample case filed in federal court:

In September 2015, the Consumer Financial Protection Bureau (CFPB) issued a Consent Order against Encore Financial Group and its affiliated business entities, including Midland Credit Management. The Order found that Encore and its affiliates, in the course of either purchasing delinquent debt or collecting delinquent debt, violated sections of the Consumer Financial Protection Act (CFPA); the Fair Debt Collections Practices Act (FDCPA); and the Fair Credit Reporting Act (FCRA). The Order identified Encore as a purchaser and collector of debt on a massive scale and as one of the largest in the industry. Encore’s policy of competitive, for-profit, massive-scale debt purchasing and collection resulted in practices that routinely and deliberately avoided or even prohibited case-by-case examination of delinquent debt factors normally consistent with established legal and professional standards. For example, purchase agreements between Encore and debt sellers acknowledged that the balances owed on many of the accounts were approximations; that many of the accounts had passed statutes of limitations for litigation; or that the files otherwise contained inaccurate information.

Encore attempted to address these discrepancies simply by requesting from the debt sellers knowingly false statements that the account information had been previously verified by hard copy. Encore’s illegal collection activity included attempting to collect debts without a reasonable legal basis; filing lawsuits to force judgments against debtors who did not owe any money; knowingly filing against consumers legal affidavits containing false or misleading information; harassing consumers by making an excessive number of calls, sometimes more than 20 times in less than two days; and deliberately misrepresenting themselves by attempting to collect debts they knew the consumer did not owe, or refusing to acknowledge the validity of consumer disputes. The CFPB ordered hundreds of millions of dollars in fines, penalties, and restitution; and has required Encore to undergo a 5-year restructuring plan requiring strict reporting and monitoring of its business activities.

Here are some past press releases of lawsuits brought on by Lemberg Law against MCM:

April 13, 2017: On behalf of our client, Lemberg Law recently filed a complaint in U.S. District Court, Southern District of Texas. The case, against Midland Credit Management, charges the debt collection agency with violating federal law.

It’s common for debt to get passed around from one collection agency to another collection agency. Sometimes, debt buyers purchase large blocks of debt and then farm it out to debt collection agencies to collect.

Our client says that MCM began calling her about a debt. She subsequently told them that she had already made payment arrangements with a previous debt collection company and requested that Midland Credit Management send her a written collection letter via email. Following that conversation, the debt collection agency called our client at least two more times that same day and at least twice the next day. Our client says that MCM also called our client’s ex-husband and disclosed information about the debt to him.

This lawsuit charges that Midland Credit Management violated the Fair Debt Collection Practices Act (FDCPA) by contacting third parties for purposes other than to obtain location information; communicating with a third party about an alleged debt; engaging in harassing behavior; and using unfair and unconscionable means to collect a debt. The lawsuit asks for $1,000 in statutory damages under the Fair Debt Collection Practices Act, plus other relief.

Midland Credit Management has been calling me non-stop, including my cell and office. What should I do?

The Fair Debt Collection Practices Act (FDCPA) protects consumers such as you from debt harassment and abuse. Specifically, Section 1692d of the FDCPA protects against abusing consumers with frequent calls, and the Debt Collection Regulations promulgated by the CFPB limit the number of calls you receive from Midland to 7 in 7 days.

I keep getting calls from Midland Credit stating a judgment was issued against me previously for a car repossessed in 2003. I am concerned this is a company that has bought up old debt and is threatening me with legal action. Is this illegal for them to do?

Midland is calling to collect a judgment they received in 2014. In all likelihood, a judgment on a debt, once they get it, can survive for a long time. Further, in some states, they can survive for several decades. It’s important for you to consult a lawyer to figure out if you received proper service of the court proceedings because you might have a right to set aside that car debt judgment.

I was served papers in the mail 2 days ago from Midland Credit even though no one called me or notified me. Is this legal?

When you receive service of a complaint on a debt, particularly from Midland, it’s important to obtain legal help. Whatever you do, don’t ignore it! If you do, Midland may obtain a judgment against you, and that might haunt you for years.

Midland Credit calls me every morning at 10 a.m. and I’ve told them that they have the wrong number. They’ve been calling me for over a year & I’ve blocked over 30 numbers from this company. How can I get the calls to stop?

Yes, you may have a valid harassment case against Midland. I’ve had multiple calls on both my cell phone and now at work from someone saying that they are serving papers from Midland Credit by the close of business on Monday. Midland Credit Management is calling me at all hours and threatening garnishment on debt that had been sold and is 5 years old. How should I handle this?

Midland’s garnishment threats are most likely illegal or inappropriate unless they already have a judgment against you. Such threats could be false and misleading under the Fair Debt Collection Act, specifically Section 1692e and 1692e(10). Even if they have a judgment, you might be able to sue them for false and misleading threats if you are immune from garnishment, such as for instance if all the money you get is Social Security or is otherwise protected.

Midland called my wife to discuss a debt that they say they have from a credit card in my name and threatened a lawsuit. Is Midland allowed to do this?

If Midland intends to sue and can sue, then they can threaten a lawsuit legally. However, if the amount is small, Midland frequently won’t sue; therefore, their threat may be considered false and misleading.

They are calling me every day asking for my brother. I don’t even know who they are, but the calls won’t stop. What can I do to get the calls to stop?

Under the FDCPA, debt collectors may not call third parties more than once to confirm your location information, and they may not discuss your debt with them. Because of this, if Midland is breaking the law by calling third parties more than once or talking to them about the debt, we can sue them for up to $1,000 on your behalf.

    Received a call from my brother,who lives in another and play me a vm message from mcm,threatening me to pay a debt I owe or they would be serving me papers the next day. I called them and they would give anything written saying I owe this debt but only willing to make payment arrangements. My first question is,are they legit and what should I do? They call constantly from 833-734-2774 and advised me they needed to hear from me within 24 hours or the would serve me with certified paper at my home or place of employment. Since Covid has let up some people are coming out of the wood works claiming or trying to sue you.

    I have been receiving multiple Calls from MCM from several different Locations even though I am debt free and have a Very High Credit Score. Lately I have resorted to Calling them (via *67/Unknown Number) and when they ask for “The Number from which You are Calling” I provide them one of their Numbers that they Call Me from. It usually takes them a few moments to figure out that I am F’n with them and they request I verify the Phone Number (lol). The next Question out of them is “What is your Social Security Number so we can look into this”. At that point I usually Cuss them Out and tell them to F Off. Scam Artists, do not even take their Calls.

    I have debt with MCM (Old Credit One Bank Acct) out of their office @320 E Big Beaver Rd, Suite 300, Troy, MI. Their attorney that filed suit against me cleaned out a joint bank account, but I was lucky to find a consumer law attorney that got it reversed – he later told me that they are still on hunt. I sent them a certified letter about the amount due but have not heard back from them now in more than 30 days. What should I do? This is hurting my report because it’s “Collection Item” and it’s updated monthly and each time I attempt to get even a $1000 loan I am declined because of the collection activity or I get a very high interest rate. The debt is now almost six years old, it was first reported on March 26, 2016, and I am in New Jersey, contact via email is best.

    I cannot believe I fell for this. They insisted I owed a 7yr old debt I know I paid, but after being threatened and having someone go through our trash, I caved and set up a payment plan. Then I get someone trying to deliver a “legal letter” saying he was hired by a creditor, I call midland and they tell me I owe a separate account that they’d never pulled up for me before. They claimed they had it for a year, I set up a payment on that too, after the acct manager “Charles” screamed at me and I hung up on him. I ended up setting up my payment through someone else, that’s when I made an official complaint about Charles. 30mins later an old Snapchat account was hacked. I traced the IP for the hacker and it’s in the legal district of Los Angeles. These people are UNBELIEVABLE. I will have a lawyer look into this, but the man who followed me today wore an encore jacket, I’ve seen the company listed here to be a partner of theirs. This is shady af. I’ve never felt so violated.

They insisted I make a payment by giving them my bank information first. I told them I wanted the payment agreement in writing first before I gave them my bank information but insisted I make a payment first while I wait for the agreement in writing through snail mail. How should I proceed .

    Midland Financial keeps calling my cell phone, they even called me at work and I told them to stop calling me, they continue to call my cell phone, and now have began send brochures they explain there pre legal and legal process of suing me. This is harrassing

    Midland Credit Management has been constantly calling me for over a month now. The first interaction I had with MCM (though I was unaware of it at the time) was roughly six weeks ago. I received a voicemail and the caller said she was attempting to get a package to me, but said nothing else. I returned the call and someone immediately answered and when I gave them my name, they said they were calling about a debt. They rambled off an address that I lived at until age 8 and also had my incorrect birth date. So, I hung up, but since then I have been constantly receiving calls from MCM. I have no idea how MCM got this number or what debt they’re even claiming is mine. Any help would be greatly appreciated. Thank you.

    I got a letter from MCM, telling me that if they don’t hear from me they will proceed and forwarded the letter to a attorney for a law sue, 8 months ago I started having trouble paying my bills from two incomes went down to one ( only mind ) I am still in a hole with all the bills Struggling every paycheck just to make it work and out food on the table I was thing about talking to these people and tray to make an arrangement with them but after reading all the reviews I am not sure what to do… my family is telling me to go bankrupt since some time I don’t even have money left for food …
    After reading all of the reviews I won’t have money to pay what ever extra money they will want to collect I would be making a very big effort just paying what I own, please give me an advice

    I received a letter in the mail addressed to a person that has never live in my home, but has debt with this company after having signed up for a credit card using my social security number. How is that legal?

    MCM calls at least 10 times a day and threatens to have me arrested and also start calling my job and family to collect this debt.They call the following numbers over and over: 832-803-3399, 832-691-2296, 832-808-0090

    They have also called my wife and threatened to arrest her as well. Telling her my debt is her debt. They are trying to collect on Barclays, but as I have explained several times, I do not have, nor have ever had a Barclays account

    Recently received a letter from Midland starting that there was a judgement against me and they wanted my financial records. The thing is, there never was a court hearing and the judgement date is the same date they started handling the collections.

    Midland Financial just recently put a levy on my our bank account. They said we owed them 10,000.00 on a credit card from 2006. Well we never owned that credit card and opened up an investigation which also said that we were a victim of fraud. They put back the money they took after three months and just last week they reopened the case again and took out more money. We called them and they said they made a mistake they will put it back in 48 hrs. Well it’s been over a week and we are still waiting. This whole thing ruined my family’s vacation the first time and now all of our bills are a mess.

    MCM called regarding a debt from 2006 which is outside of the statute of limitations and became very angry when I told them that. They started to demand I discussed the matter with them. After reiterating again, that I was not going to discuss it because of the time length, I then hung up and blocked the first number.

    Getting advertisement lawyer letters suddenly .according to the “ads” there is a lawsuit filed with my County from Midland credit collection agency if I have not been served I soon will …this is an outstanding debt that they took over from Care Credit which I could not pay because when I did pay extra ..the next statement was more than the first one I just paid.. i..t never went down and then my husband retired due to health problems and I’ve been on a fixed income for 3 years now with an income of 497 per month there’s no way I can pay this on our fixed income I am the only one being sued not my husband this is never happened to me before

    Set up Payment plan gave them my bank in now they are taking more payments out than agreed upon. they even sent me a letter on when they were taking a payment out.called them yesterday they told me they had to had the complaint to the original person I talked to

    I’ve recently moved to another city. I got a notice from UPS that a package from MCM in Maple Grove, MN was left a for me at my old address. My former landlord is holding it for me. Why/What would this company be sending me a package. I do not remember ordering or ever even dealing with this company. Would a collect company send a package? I’m kind of scared to open it.

    I was served papers last week from MCM suing me over a debt with synchrony bank for a balance less that 1k. I called and got a payoff in full offerfor 799. I paid that amount printed the page from my online acct before and after submitting the payment. The before page showed a payoff amount of 799. After I made the payment, it said I still had a balance of 171.00 and now almost a month later , I am notified by experian that they placed another delinquency on my report for an amount of 484.00…. WTH? All of this totaled is far and above the amount they are taking me to court over!!! Shady LLC. I’ll go to court because I have every persons name and time stamp I spoke with AND printed before and after pages when making that payoff payment! These people are seriously dumb and I’m confident the judge will say the same with all the prof I have. You can’t come back and say I owe you 600 more than what you reported to the courts… stupid

    Russell Florence (compliance officer) just offered me my “last chance” and he’d be coming to my home today and if I’m not home they will be coming to my work for me to sign for papers. His closing statement was “see you in a few hours.” Yeah, that’s not freaking creepy and illegal. Bast*rds. The (fake, I’m sure) number on my caller ID was 513-729-6024 but I should call back to 888-203-3603 and ask for the Legal Dept. Called it… answered “MIDLAND, Cynthia, how can I help you?” so it’s direct to someone at Midland which is a collection agency. He left the same threatening messages with my son on his phone. First of all, he’s not me. Secondly, I’m not necessarily who you are looking for. Third, you’re breaking laws dumb dumb. And lastly, I’m really ticked off. Thanks for listening.

    Trying to settle credit card debt with Midland as they took over the debt, We settled on a monthly payment, they however refused to take my monthly payment by mail, they want access to my bank account, no one gets access to my account, I do not trust them!

    I got a letter stating that I owed almost $1,000 to Synchrony Bank – Amazon from 2017. I have NEVER had an account or card with Synchrony Bank and I have never had a card with Amazon.

    Midland Credit bought an old debt I no longer owed, served my grandma who lived 650 miles away and filed a judgment against me. Then filed with the court to garnish my wages over an ELEVEN year old debt that they can’t prove that I owe. This is ridiculous!

    Same here as most above from MCM. I acknowledge a debt but they sent a pre legal statement out with an over inflated amount. They call numberous times daily.

    They keep calling me asking for chad stackhouse when they answered the phone they didn’t identify who they were what company the were calling from and why they were calling they answered the phone like it was there personal phone they kept asking for Chad stackhouse and when I said I wasnt him remove my number from your list they would then continue to speak not only that but they would call from other numbers asking for the same freaking person! What can I do to get this to stop

    Midland Credit Management has called me countless times. That’s on a daily basis as well. Yes, I do acknowledge a debt, but now they are sending me correspondence saying that they can have a lawyer in my state contact me for litigation for this said debt. I have tried to settle this debt, but they won’t settle for anything less than the full amount.

    I dont know who these people are,they never every called me or left me a letter,i got a email from UPS saying a package will arrive tomorrow,so I wondered who is sending it and it said MCM on the email.Do i refuse it or what?I googled it and its a company named Midland Credit Management.From what i’ve been reading they are a scam.Can you please reply back to me on my email,i’m very deaf in both ears?Thank you!

    I am getting UPS packages left at my door for my deceased brother. They won’t bug off. They are threatening me by telling me I have to pay his debt or send them proof he’s dead. Very troubling.

    I live in Maine and got a pre-leagal notice from mcm and I can’t pay them they want a little more that $1600. What should I do. If I ignore them will they go away like other set collector’s or will the sue me?

    I have excellent credit. There is no reason for Midland Credit to call me. They call from various states at all hours and they never leave a message. I keep blocking their numbers and they keep calling from different numbers. I have no outstanding debt.
