Is Zwicker & Associates a scam?

They’re legit. According to the Better Business Bureau (BBB),  Zwicker & Associates is a legitimate firm founded in 1981 in Andover, MA and incorporated locally in 1991. BBB opened its file in 1988 and lists Zwicker & Associates under the business categories of Attorneys & Lawyers; NAICS: Offices of Lawyers; and Collection Agencies. The BBB opened its file in 2002. Buzzfile estimates Zwicker & Associates’ annual revenue at $84.1 million and the size of its headquarters staff at 400 people.

Zwicker & Associates, P.C. “is a law firm whose primary business function is debt collection.” According to its website, Zwicker & Associates “has been providing services within the Accounts Receivable Management Industry for more than twenty years…[provides] collection, litigation, and bankruptcy services for [its] clients… [and is] dedicated to providing outstanding client services.” Aside from these basic statements and a link to the Service Members Civil Relief Act, their home page provides little information about debt collection; consumer protection laws like the Fair Debt Collections Practices Act (FDCPA); or references to outside consumer resources. The additional pages of their site list career opportunities, legal concerns such as Terms of Use, a portal to client services, and a page allowing consumers to consent to their Electronic Disclosure of Payment Authorization agreement.

Most delinquent accounts are placed with law firms like Zwicker & Associates only after all other collection efforts have failed. Zwicker & Associates’ website reflects its specialized focus and its reliance on a clientele less responsive to typical marketing and advertising techniques.

How many complaints are there against Zwicker & Associates?

The BBB lists only 19 complaints against Zwicker & Associates in the past 3 years, with 6 closed in the past 12 months. Most of the BBB complaints allege problems with billing and collection services such as difficulty providing validation of debts or changes in payment or billing agreements. The BBB site provides very little detail about these complaints. The six negative reviews allege unethical and dishonest legal practices. Absolutely.  You can sue a debt collector. Here is a Sample Case Filed in Federal Court:

In 2017, a New York man filed a proposed class action lawsuit against Zwicker & Associates, P.C. claiming the company sent debt collection letters that failed to comply with requirements set forth by the Fair Debt Collection Practices Act. According to the suit, another debt collector had attempted to collect on the plaintiff’s alleged debt and sent him a letter on or around May 25, 2016 that specified a balance of $34,680.27. On June 7, 2016, the defendant supposedly sent the plaintiff a letter informing him that his balance was $35,717.21. The June letter neglected to mention accruing interest or late fees, but the increase in the plaintiff’s balance indicated to him that extra charges were being applied, according to the complaint. The suit argues that Zwicker & Associates violated the FDCPA by failing to clearly disclose the amount of the plaintiff’s alleged debt and leaving him unable to settle his account.

In 2011 in United States District Court for the District of New Jersey, Camden Vicinage, a judge in a civil action against Zwicker & Associates issued an Opinion and Order regarding the plaintiff’s motion for a class action settlement. The initial complaint was filed in 2009 and alleged that Zwicker & Associates had repeatedly violated provisions of the FDCPA by sending out debt collection letters that failed to disclose the amount of the debt owed; failed to specify or itemize what charges were being included in the debt; used false and misleading language implying that Zwicker & Associates exclusively can determine the validity of a debt; and used additional language intended to confuse the recipient.

The settlement in this case included “all people in the United States, Puerto Rico, and Guam who, during the period from August 6, 2008 through the date of the Court’s Order preliminarily approving the settlement…were mailed a collection letter by [the] defendant,” a class estimated at 800,000 people. The settlement further called for $2,000 to be paid to the lead plaintiff; court costs and attorney fees; and for class members to release all claims against the defendant in exchange for a payment by the defendant of $32,289.44 to the United Way to provide class members with financial literacy training. The judge in this case denied the motion to approve the class action settlement, but not because the complaint lacked merit.

Ultimately, the judge indicated that he was troubled by the plaintiff’s attempt to deprive such a large class of their right to pursue compensation for losses while securing $2,000 for herself. In addition, the compensation offered in return for their agreement to waive their rights was so insignificant that in his judgement the proposed settlement did not represent a just resolution.

    Zwicker is racketeering and laundering money here in WA. The courts and the WSBA are all in on it and only want to take your home so they can sell it to the judges,or attorney general for pennies as a trade off. Arbitration is a joke it’s fixed just like the courts are in WA. Zwicker is not license in WA as a debt collector and all attorneys and firms collecting debt have to be licensed in WA state. Everything is fixed here in the courts they are worst then Zwicker uses Oregon firm to collect debt here and basically steals your bank account but would rather take your home, then launders it Using fake company’s and of course WA allows it because they get a big piece of the pie.Arbitration is fixed they use old employees to be the arbitrator who is the biggest guardian abusers and steal the homes of the elderly and their life savings. It’s disgusting and any attorney here in WA that try’s to help us will have there license revoked from the WSBA because all of them are working together. Amusing that the attorneys in this firm are dumb as rocks. Can’t wait until they are all caught laundering money and evading taxes for the last 10 yrs. if you need any evidence or help lmkw. I loathe the sum that has taken over WA but the proof I have connecting all them is wicked. AMEX is allowing Zwicker to take CC holders who aren’t even in debt or owe on the account. Zwicker gets desperate and just starts taking what ever he wants. Soon it will come to a end.     Been paying Zwicker for Discover for 13 months $100 per month through a debt relief company. All payments have been made as per court order (yes they took me to court and the judge said I had to pay in full). Now they are asking for a Final Judgement because they say I have not lived up the order. I have proof all payments were made. They made no attempt to ask for said proof and have not investigated the matter. Just automatically proceeded to ask the judge for a Final Judgement. Now it’s up to me to submit proof to the judge.

    I just received a letter from an attorney that said they saw I’m being sued by Zwicker for Amex. I’m working with a Debt Relief program and have Informed Amex of this. Today there was a note on my porch that a Processor attempted to serve me court papers and would return. I know it has to be this Zwicker Account. My Debt Consolidation Company told me to get the papers and submit to them but I’m worried. Should I call Amex myself?

    My son has not received any collection letters from Zwicker and Associates but was left a notice on my door to contact within 24 hours from Texas Supreme Court by a Certified Process Server.He does not even live in Texas.Is there anyway i can try to negotiate his debt?

    Zwicker & Associates send me a notice of summons to appear for court for a debt owed and to explain my case to appear on 5/12/2019. I received the summons on 5/19/2019 at around 4pm. If I needed to appear for court clearly it would be too late as if they are trying to force a summary judgement due to no appearance. Not to mention their filing date is 5/7/2019. The checked response prior to the “Order to show cause” says I must respond at least 10 days prior to the hearing which would have been the 2nd of May almost three weeks ago.

    I have been paying off my creditor, Discover Bank, through Freedom debt. There are only 3 payments left and Zwicker and associates continue to harass me because they want me to sign some stipulation agreement. I did not sign and now they are trying to bring a judgement against me. They are like bloodsuckers.

    served Warrant in Debt but not in my current legal name, in my maiden name. Zwicker firm did not provide itemized debt either.

    Zwicker and Associates filed a Summons an Complaint at the end of 2016 for a debt owed to Synchrony Bank. I filed an answer within a few days of receiving their papers and didn’t hear from them for over one year. Late last week I got papers from Zwicker that said they will ask the Court to grant a Summary Judgment.

    I am surprised they are doing this, given they already know they can’t collect this from me as I have protected income (disability), of which I provided proof when I filed my answer to the Summons.

    I own no house or car…..or real estate. Not much money in the bank at all. It is not cost effective, imho, to take this to court, esp. since the debt is just over $7k.

    I want everyone to know that if you are sued by Zwicker, don’t ignore their letters. And if you are asked to go to Court, then GO. Do NOT ignore the court date as they can get a default judgment against you.

    I wish I can get them to leave me alone, but they won’t listen to reason.

    Lemberg Law has helped me on more than one occasion, because, my son’s name is the same as mine only he is the 2nd (II). Creditors chase after me to pay his bills, but, Lemberg helps the collectors realize they are really making a mistake. Astounding that bill collectors do not care what everyday people such as I have to say, however, when the collectors are notified that Lemberg is your attorney and his team reaches out to the collectors – all collection communication stops immediately!
