They’re legit. Rash Curtis & Associates is a corporation that has been in business for 39 years, with a founding date of 1977. The BBB has maintained a listing for Rash Curtis since 2000. Buzzfile indicates the parent company of Rash Curtis is K.B.R., Inc. Located in Vacaville, CA, they have a reported annual revenue of $7.9 million and a staff of 59 people at the headquarters location.

Who does Rash Curtis & Associates collect for?

Rash Curtis & Associates is a licensed collection agency whose main focus is on medical bills resulting from “commercial insurance, managed care insurance, Medicaid, Medicare, self-pay, self-pay residuals, automobile injuries, and workers’ compensation.” All calls to Rash Curtis are monitored, and all recorded information is used to collect debts. Rash Curtis also has an in-house legal department whose employees litigate claims that meet certain criteria, such as patient bills with higher balances; patients with good credit ratings and available credit; and patients with good employment histories. They also offer a service known as “early-out,” through which collection activity is initiated before legally defined delinquency has begun.

Rash Curtis states as its mission its intent to provide its clients the highest level of service in the debt collection industry by improving cash flow; treating patients with respect; protecting client reputations; maintaining compliance; and providing exemplary customer service. Their website states that they measure success by the results of liquidation efforts and by feedback from creditors whose delinquent accounts they purchase. Aside from training in Health Information Portability and Accountability Act (HIPAA) legislation, the Rash Curtis website does not mention any laws that regulate the collections industry, such as the Fair Debt Collections Practices Act (FDCPA) or the Fair Credit Reporting Act (FCRA). Thus, Rash Curtis presents itself as a debt collection company that defines success by the amount of money it brings in for creditors, rather than the degree to which it maintains ethical and responsible business practices, especially with regard to the rights of people under the FDCPA.

How many complaints are there against Rash Curtis and Associates?

The Better Business Bureau lists a total of 78 customer complaints against Rash Curtis and Associates—46 for advertising or sales issues; 24 for billing and collections issues; 2 for delivery issues; 1 for guarantee or warranty issues; and 5 for problems with service. Of the 78 closed complaints, only 15 were resolved to the satisfaction of the consumer. Most of the complaints indicate violations of FDCPA prohibitions against abusive language, harassment, threats of legal action, excessive phone calls, and misrepresentation. All three customer reviews are negative. Justia lists at least 10 cases of civil litigation in which Rash Curtis & Associates were named as a defendant.

Sample cases against Rash Curtis illustrate the degree to which they choose to view the law more as an obstacle to higher rates of account liquidation, and less as the basic foundation of professional success. In 2016, Rash Curtis, acting as defendant, filed an Opposition to Plaintiff’s Motion to File First Amended Class Action Complaint in a case against an individual plaintiff attempting to include additional complainants with similar concerns in the same case. For Rash Curtis’ opposition to have succeeded, they would have had to prove undue delay on the part of the plaintiff; futility; or unfair prejudice against the defendant. The Judge’s Memorandum Opinion and Order denying Rash Curtis’ motion illustrates how their Motion did not come close to meeting any of these criteria. Furthermore, because Rash Curtis has an in-house legal team, this type of frivolous litigation is demonstrative of an unethical manipulation of the court system that must be regarded as deliberate, and bordering on obstruction of justice. Next, in 2017, a judge denied a motion to enforce a settlement in a class-action lawsuit. During the case, the plaintiffs proved allegations of improper collection calls for unverified debts, yet the settlement offer did not specify terms releasing the plaintiffs from the defendant’s debt claims and also requested that they waive certain of their rights under California law. Again, because Rash Curtis employs an in-house legal team, these tactics should be viewed as a deliberate effort to violate the spirit of the law for financial gain.

October 31, 2015. On behalf of our client, Lemberg Law recently filed a complaint in U.S. District Court, Central District of California. The case, against Rash Curtis and Associates, charges the debt collection agency with violating state and federal law and asks for $1,000 in statutory damages, plus other relief.

Debt collection calls can be a hassle, but debt collection calls for someone you don’t even know can be a nightmare. But that’s what our client says happened to her. She says that Rash Curtis and Associates started calling her this past July in an attempt to collect a debt from someone she doesn’t know. Our client told Rash Curtis and Associates that they had the wrong person, but they kept calling. Once our client hired us, she told Rash Curtis and Associates that she was represented by an attorney. She gave them her phone number and they said that they couldn’t find her number in their system. Nevertheless, she received another call from them.

This lawsuit charges that Rash Curtis and Associates violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by communicating with our client about a third-party debt; and by communicating with her after Rash Curtis and Associates knew our client was represented by an attorney. The lawsuit also charges that Rash Curtis and Associates violated the Rosenthal Fair Debt Collection Practices Act (RFDCPA) by engaging in harassing behavior.

October 13, 2015On behalf of our client, Lemberg Law recently filed a complaint in U.S. District Court, Northern District of California. The case, against Rash Curtis & Associates, charges the debt collection agency with violating federal and state law. It asks for $1,000 in statutory damages, plus other relief.

Debt collection calls at work are intrusive, but they’re even worse when you’ve already agreed to make payments. That’s exactly what our client says happened after she made arrangements with Rash Curtis & Associates to make payments on a debt. She says that Rash Curtis & Associates called her work number several times in order to finalize the payment plan. Our client wasn’t able to take the calls for work-related reasons. Still, Rash Curtis & Associates faxed an employment verification form to our client’s employer – even though Rash Curtis & Associates already knew she worked there. The form prominently displayed a question about whether or client had any “current wage garnishments or attachments,” even though Rash Curtis & Associates hadn’t filed suit against our client nor obtained a judgment against her.

Needless to say, our client was very upset. She called Rash Curtis & Associates and told them that her employer doesn’t allow her to take personal calls at work, and to stop calling there. Nevertheless, Rash Curtis & Associates continued to call.

The lawsuit charges that Rash Curtis & Associates violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior; by talking with a third party about a debt; by contacting our client as her workplace, knowing that her employer prohibited such calls; by employing false and deceptive means to collect a debt; and by using unfair and unconscionable means to collect a debt.

    They call and harass me and my parents. They put 5k on top of the original medical bill. They never submitted a claim to my insurance and claimed that it wasn’t paid. They messed up my credit.
    On top of that the debt is 5 years old which is violating the
    statute of limitations In CA and it should be uncollectible.

    This place is a bullcrap sending my boyfriend a medical bill in the mail for something he never even had done… someone called him on his cell phone and told him that it said his address was somewhere in CA when he hasn’t even been to CA in over a decade. They also said that later 4 digets of his social matched what they had but when he called back they said it was a mix up and that they found the right guy. He said it’s a common mistake because alot of people share the same name… they wouldn’t realase any more info and couldn’t tell him how it happened. How did they get the last four numbers of his social if it was the wrong guy? They assured him It would go away.

    These folks are clowns. Honestly, I have a couple debts that just showed up JUST on my Equifax credit report (Transunion/ Experian) did not show up. The Community Hospital of Monterey Peninsula and I have always had discrepancies in billing statements. Rather than a resolution, CHOMP used to send their bills to this group. Instead of doing any due diligence in the debt acquisition, Rash hit me with a barrage of HIPAA non-compliant calls without knowledge who the debt was regarding. Not only was the debt load fraudulent (incorrectly billed) it was nearly three quarters of a bad credit report (score went from 700 to below 500). In total it wasn’t a large debt (some were below 20 dollars) but multiple reports of petty “debt” and non stop calls have left me damaged as a fiscally responsible consumer.

    They are continuously calling my cell phone which is also used while I am out at clients causing it to ring frequently. Additionally, they are continuously calling my employer which is not allowed and is having a negative impact on my profession risking my employment. Not to mention the embarrassment that my office now has knowledge of personal matters.

    They say in 09 I went to San Mateo hospital! I was living on Nevada from 09-10 then Pollock pines till 2012, I have insurance why would I drive to sm county when I go to john Muir which is my hospital and 3 hours closer! The guy was rude, snide, but hey I should sue them! Well only 2 more days till 7 year mark, but its not mine!

My phone does not ring when they call but they leave either a robo voicemil or no message at all. I have asked that they remove me from their call list and they continue to call and call from various numbers. this is beginning to feel a lot like harassment and is threatening to me.     How do I go about complaining? They call me sometimes 3 times a day. I told them to stop. They still call. My son is disabled and has medi-cal I told them this… so I should not have a medical bill but yet they still call…. What do I do? Any suggestions?
