Is Profit Services Group a scam?

They’re legit. According to the Better Business Bureau (BBB), Profit Services Group, LLC is a legitimate collection agency and billing service. The BBB established a profile page for PSG in 2010. Buzzfile indicates that PSG was founded in 2010, generates an estimated $1.2 million in annual revenue, and employs an estimated 10 people at its headquarters location.

PSG, LLC does not maintain a publicly accessible website. A basic search for PSG using an internet search engine reveals a profile page on the LinkedIn professional networking site for a similarly named company also located in Georgia—Profit Services Group, Inc. (PSG, Inc.). PSG, LLC is located in Savannah, GA, while PSG, Inc. is located in Duluth, GA. The LinkedIn profile page for PSG, Inc. does not indicate whether these companies are related. The website information for PSG, Inc. listed on this profile page is for a non-operable web address (http://n/a).

According to the BBB, Tim Shaffer is the Chief Executive Officer of PSG, LLC. The business directory website BizStanding.com also lists Tim Shaffer as the CEO of PSG, LLC. According to Buzzfile, David Freitag is the President of PSG, LLC. According to both Buzzfile and BizStanding, Freddie Profit is the Board Chairman ofPSG, Inc.

LinkedIn’s profile page for Profit Services Group, Inc., shows minimal information for two employees—one is located in the greater Atlanta region; the other is located in the Savannah area. LinkedIn also has profile information for David Freitag, which indicates he has a background in collections and confirms his position as President at PSG, LLC. The LinkedIn profile for Tim Shaffer indicates that he is located in Duluth. The LinkedIn profile for Freddie Profit indicates that he is located in Savannah. Neither of the profiles for Shaffer or Profit provide any information about their educational or professional backgrounds.

According to its LinkedIn profile page, PSG, Inc. “provides end-to-end, highly-differentiated, and industry-based services, including marketing, consultancy, and management services…and delivers highly-strategic and deeply practical solutions that propel business growth and efficiency at every level.” However, according to Buzzfile and BizStanding, PSG, Inc. “primarily operates in the building and office cleaning services”; “apartments, deck cleaning, floor cleaning, furniture sales”; and landscape maintenance industries.

How many complaints are there against Profit Services Group?

As of March 2019, the BBB has given Profit Services Group, LLC a rating of F. The BBB has closed 59 complaints against PSG, LLC in the preceding three years, with 22 complaints closed in the previous 12 months. Most of those complaints cited problems with billing and collections, although 19 complaints cited problems with customer service. As of April 2015, the Consumer Financial Protection Bureau (CFPB)has closed 37 complaints against PSG. Justia has not listed any cases of civil litigation involving PSG.

The BBB has posted a notice about PSG’s response to the complaints it has received.According to the BBB:

“On April 27, 2017 Profit Services Group… responded to select complaints closed as ‘unanswered’ with the following blanket statement:

“Response to complaints on Profit Services Group.

“Profit Services Group is a collection agency located in Savannah, Ga. We are a company that follows the FDCPA laws to the exact and full extent on every telephone conversation and written communication. All of our calls are recorded. When a complaint is received the recordings are reviewed. All accounts are notated in detail when a delinquent account is worked. Those notes are matched up with the recording when a complaint is reviewed. All debtors are sent a letter within five days of the first initial contact with the required VOD statement and mini Miranda. After reviewing numerous complaints from the BBB that basically say the same thing this letter will serve to answer the same repetitive accusations. It is my observation that the debtors believe or have been told that a complaint will resolve their problem. In most cases the problem can be solved simply by paying the bill that is owed. It should be noted that in a greater majority of the cases that are complaining they could have avoided collections by responding to the client that they owe before it was sent to collections. It should be also noted that the greater majority of the complaints are never concerned about resolving their account by paying. Most are looking for their bill to be written off or their credit cleared with no type of payment.”

PSG’s statement goes on to dismiss as irrelevant all consumer complaints that cite problems that allege rude collection staff; use of abusive language by collection staff; excessive and repetitive calling; calling early in the morning or late at night; attempts to collect debts not owed; threats to take actions that cannot legally be taken; failure to identify themselves as bill collectors or to validate debts;and many other complaints. None of the details of consumer complaints are available for public viewing.
In December 2018, a complainant informed the CFPB that she had “received numerous calls daily to her cell and work phone from” PSG. The complainant stated that she had “verbalized to PSG…not to not call her or her job and that she can’t take calls at her place of employment.” She also stated that her “account is not in collection with” PSG, and that the “medical account in question is being paid directly to …the medical billing department” of her insurance company. The complainant alleged that PSG had stated that they “will continue to call her no matter what.” The complainant stated that she had maintained call logs to prove that PSG had violated the FDCPA’s provisions against harassment.

The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.
