What is the NFCU TCPA Text Message Class Action Settlement?

A $9.5M settlement has been reached in a class action lawsuit alleging Navy Federal Credit Union violated the Telephone Consumer Protection Act by spamming thousands of consumers with unwanted marketing text messages.

Plaintiff Ben Hawkins claimed he had received nearly 500 robotexts from the credit union despite the fact he hadn’t consented to receiving such messages, had never had an account with Navy Federal Credit and had never been a customer in any other capacity. NFCU denies the allegations but has decided that settlement is best for all parties involved.

The Settlement affects all persons who, between Sept. 15, 2015 and March 23, 2020, were sent one or more unwanted  text messages from Navy Federal Credit Union.

If the Settlement is approved, Class Members will receive a pro rata share of the $9.5 million settlement fund which divided amongst all members could equate to a monetary award far more inferior than what filing an individual suit could result in.

After attorneys’ fees and expenses and lead plaintiffs’ incentive awards are deducted, remaining eligible persons would receive an estimated cash award of only $100.00 based on a 10% claim rate, but could be less upon final approval.
