Is DirecManagement Inc a scam?

They’re legit. According to the Better Business Bureau (BBB), DirecManagement, Inc.was founded and incorporated in 1997. The BBB established a profile page for DMI in 1999, and DMI has been a BBB-accredited business since 2014. The BBB lists DMIas a collection agency and skip tracing and litigation support corporation. Buzzfile estimates DMI’s annual revenue at$3.5 million and the size of its headquarters staff at 38 employees.

According to its website, DMI is “a single-location, 3rd-party collection agency that… serves businesses nationwide.” DMI states that it is “committed to meeting the requisite state and federal requirements to handle collection accounts in any of the 50 states” in its effort to meet the needs of its clients.

DirecManagement provides collection services for medical and healthcare providers; consumer retail lenders; collection accounts assigned by debt purchasers; and commercial collections. DMI’s medical collections division is “HIPAA compliant…and experienced in collecting medical receivables for various practices and hospitals.” DMI’s medical collections staff has a “deep understanding …of handling the nuances of insurance reimbursement.” They accept delinquencies from “hospitals, healthcare clinics, physicians and surgeons, ambulance services, and surgery centers.”

DMI’s retail and commercial collections division utilizes “full-service accounts receivable management services… to provide excellent collection results for retail and commercial accounts…and build continuity between the creditor, debtor, agency, and counsel, to deliver the highest financial recovery.”

DirecManagement also provides skip tracing using “advanced data-linking and search technologies…to find people, assets and businesses.” DMI’s litigation service uses an “established, …sophisticated network of attorneys throughout the United States,” and includes a “close analysis of client… portfolios to allow… for a mutually beneficial litigation relationship.” DMI’s asset location service helps clients “locate assets—such as property, vehicles, business ownership, and employment—to provide…the information needed to collect or recover.”

DMI cites affiliations with several professional and trade organization such as the International Association of Credit and Collection Professionals (ACA International). Their website does not include a dedicated page with links and references to consumer protection resources, laws, or enforcement agencies; however, their online payment portal includes a legal disclaimer about consumer rights, with a link to the Federal Trade Commission (FTC) website.

Complaints against DirecManagement Inc cite problems resulting from disputes about the validity of debts, the accuracy of information reported to the credit reporting agencies, and allegations of harassment and threats.In February 2019, a complainant stated that DMI representatives had “harassed him at work multiple times.” The complainant stated that the debt in question had been “paid by insurance the year it was created.” He alleged that DMI had been “sold a bad debt” that his insurance company had already paid. He stated that DMI representatives “had called his job 6 times…after being told not to and tried to get his information from his personnel department without faxing valid papers.” The complainant “contacted his insurance company and” verified that “the medical debt was paid in the window of time service had been rendered.” Regardless, he stated that DMI had “called him before 8:00 am on a Tuesday.” He allegedly “told the representative not to call his job and that all correspondence should be through the mail.” However, he stated that the representative“cut him off and said the matter needed to be handled and …that DMI would garnish his wages if he did not pay.”

The complainant also stated that a co-worker from his personnel department later that morning told him that the “same woman called trying to get his income and other information without verification,” and that he had “informed his coordinator of what happened.” In response, DMI stated that the complainant must have DMI “confused with another company, because most of what he has listed in his complaint is incorrect.” DMI claimed that they had “left a message for him at work one time” and had “never spoken to him at work.” DirecManagement acknowledged that they had talked to him on his personal phone twice, and claimed to have sent debt verification at his request. DMI also denied the allegation that they had called before 8:00 am. They also denied his claim that the bill had been previously paid, stating that “it will continue to be reported to the credit bureaus as a disputed account for the legally allowed amount of time.” DMI requested that the complainant send them proof of payment.

DirecManagement Inc Calling You?

The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).
