Understanding Your Debt Collection Rights

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

But here’s the rub: If you want to enforce your rights, or recover money for violations — you need to sue. These laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

If your FDCPA rights have been violated, you have every right to take the debt collection agency . The law states that the debt collection agency must cover you up to $1,000, in addition to your court costs and lawyer fees.

    I had negotiated a settlement with Cooling and Winter and was told by a Mrs. King that my settlement agreed would be emailed to me. After 24 hours, no agreement settlement was received. Called Mrs. King again and was informed it never reached her office and to resend it marked “2nd Request” which I did. 72 hours later no agreement. Called Mrs. King back only to go to her voicemail stating she’ll reply back before the end of the day. 48 hours later, no return call. I’m trying to settle without having to go to court , have had the agreed upon amount in my checking account having authorized Automatic Withdrawal, yet she seems to avoid any further communications with me about our agreement. Beginning to feel like this company is a scam. Court date is Tuesday so I guess I’ll produce my emails concerning my settlement agreement and their lack of following up on their agreement.
