- Subaru Crosstrek, Ascent & Solterra Side Mirror Vibrates Class Action Lawsuit
Robinson v. Subaru of America, Inc.
Case Information
- Case Number: 1:24-cv-09334
- Case Status: Case in Progress
- Court: United States District Court, District of New Jersey
- Filed: September 20, 2024
Lemberg Law seeks to represent a putative class, led by Katelyn Robinson, in a lawsuit against Subaru of America, Inc. The lawsuit alleges that certain Subaru vehicles—including the 2024 Subaru Crosstrek, 2024 Subaru Ascent, and 2023–2024 Subaru Solterra—have defective driver-side exterior mirrors that shake or vibrate excessively while driving. Plaintiffs allege the vibration causes distorted reflections, reduces visibility, and may pose safety concerns.

Complaint
The complaint alleges that the driver-side mirrors in the affected vehicles suffer from structural and material defects that cause mirror shaking and excessive vibration while driving. This defect renders the mirrors ineffective for safe driving and compromises vehicle safety compliance.
Key Allegations Include:
- Mirror Vibration: Driver-side mirrors shake and distort reflections while driving.
- Ineffective Repairs: Replacement mirrors allegedly exhibit the same defect.
- Safety Concerns: The vibration interferes with visibility and driver awareness.
- Lack of Resolution: Subaru has not issued a recall or provided an effective fix despite consumer complaints.
Manufacturer Response
Despite being aware of the defect through pre-sale testing, consumer complaints, and warranty data, Subaru has not issued a recall or provided an adequate fix for the mirror shaking. Replacements use the same flawed design, and customers report unresolved issues even after repairs. Subaru’s lack of transparency and unwillingness to address the defect has left customers frustrated and financially burdened.
Claims for Relief
The plaintiffs seek:
- Free Repairs: Permanent and defect-free driver-side mirrors for all affected vehicles.
- Compensation: Reimbursement for repair costs, diminished vehicle value, and safety-related damages.
- Injunctive Relief: Mandatory recalls, improved transparency, and adherence to safety standards.
- Punitive Damages: To penalize Subaru for knowingly selling defective vehicles.
Case Update
In December 2025, Subaru filed a motion to dismiss the lawsuit. The court denied the motion in part, allowing key warranty and consumer-protection claims to proceed. The case remains ongoing.
