Is Rushmore Service Center a scam?

They’re legit. According to the Better Business Bureau (BBB), Rushmore Service Center, LLC is a legitimate collection incorporated in 2009 and started in 2011. The BBB established a profile page for RSC in 2015. Buzzfile estimates RSC’s annual revenue at $170,122 and the size of its headquarters staff at 6 employees.

According to its website, RSC“is a nationally licensed collection agency…dedicated to delivering superior performance, outstanding regulatory compliance, and building strong customer relationships while serving not only our clients but our community.”

RSC’s “enhanced analytical capabilities allow us to construct models that result in superior contact rates and to successfully target debtors who are most likely to pay.” RSC management uses several tools and methods to maximize return on investment, including “latitude debt collection software; …advanced technology platforms with ongoing reviews and upgrades; …SAS business analytics software; predictive and automated dialing; high level quality control/regular audits; and continuous training and monitoring.” In addition, RSC advertises its responsiveness to clients via services such as “dedicated and ‘on call’ contact availability; daily online reporting via 24/7 web access; and …customer status reports.”

Who does Rushmore Service Center collect for?

Rushmore Service Center does not specialize in any one area of delinquent accounts, instead providing “third party collection services across multiple lines of business,” including credit card, healthcare, retail, purchased debt, utilities, and government. In addition, RSC provides “first-party collection work to the above listed industries with exceptional performance at competitive prices.”

As for compliance, Rushmore Service Center cites “substantial resources available to ensure all collection activities are performed in accordance with the FDCPA, applicable state laws, client work standards, and internal policies and procedures, including several measures to… ensure… highly compliant results while minimizing risks associated with data security.” Their website does not provide a consumer resources page, and their Contact Us form fails to include a disclaimer identifying them as a debt collector. However, they have included a link to the Federal Trade Commission’s (FTC) information page about the FDCPA at the bottom of their Frequently Asked Questions page.

Absolutely.  You can sue a debt collector. Here is a Sample Case Complaint:

Complaints against Rushmore Service Center commonly cite problems with hostile and aggressive collection tactics that potentially violate the FDCPA. For example, in December 2017, a complainant indicated an RSC employee had been contacting him at his place of employment even after he had repeatedly asked them not to. In addition, the complainant indicated that after researching the matter, he discovered that RSC was attempting to collect a debt that was already paid.” Thus, the complainant reported two violations against RSC: “not only have they harassed me at my place of employment, but they have a debt that has been paid.”

In March 2017, a complainant indicated that Rushmore Service Center representatives had repeatedly called a mobile number he had just acquired. Because the number was brand new to the complainant, he claimed that “therefore he has … no connection to this company.” When the complainant called RSC back to resolve the problem, the representative “immediately demanded his name and social security number.” After he “verified his phone number with them and explained that since this was a new number…he had nothing to do with them, …they continued to demand… personal information and became rude and aggressive when he told them to stop calling.” The RSC representative allegedly “refused to say anything other than they were a debt collector trying to collect.”

In April 2016, a complainant alleged that RSC representatives had been placing “harassing and threatening telephone calls and…threats…in regards to …a debt of $400.00.” The complainant claims not to have “applied for or opened a credit card account” and that the “account is unauthorized and fraudulent.” The complainant indicated that he was “a victim of identity theft… and that he had filed a police report,” and had provided Rushmore Service Center with a police report number.

In February 2016, a complainant who claimed not to have owed “debt to anyone for over the last twenty or more years” had been receiving “at least four calls a week” from RSC. The complainant said he had not been answering calls identified by caller id, but that the “calls from them have been going on for several months now and they need to stop.” The complainant indicated he “suspected they have the wrong number and need to correct their file.”

In response to these complaints, Rushmore Service Center indicated that they either disputed the facts of the complaints or believed they had“acted appropriately as authorized by contract or law.”

The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

    They keep calling but can not explain what I owe when I know I dont have any debt I now feel like I’m being harrassed by them

    They are ruthless. I called them when I realized there was a bill there. I had never actually received any notices from them so I had no idea what was going on til I talked to Sanford. When I talked to them I explained I did not have any extra money and that I’d pay with my tax money. No additional contact from them was received. This was in November. I received a small claims court summons for 313 from them January 30th. I called immediately and worked out an arrangement which I kept. It took me three calls to get the correct amount they kept changing in and increasing it. I made a 56.00 a month arrangement for the rest I owed for the 28th of the month. I specifically asked what’s would stop them from sending the rest. I was told as long as I paid by the end of the month I’d be fine this was on February 11. I got a letter on the 21st from then stating if I didn’t pay by March 26 they could take legal action. So I called then and explained what I was told. Was told on February 19 they filed court paperwork on my remaining balance and could not explain to me why they didn’t honor our pay plan. I’ve since left two messages with no reply to get what I actually need to pay and have not received court paperwork. I have no idea what’s going on

    Thanks have a health bill i have bean paying normally… And then the company sent my account to Rushmore for collections. There were a few payments that were not on time but i always talked to the parent company and i made an arrangement for my payments to come out… i will assume the at the point i had my card locked and didn’t realize that i needed to keep it open for an automated payment to go through…. i have not ignored paying my bills.. but i have gotten calls all the time from Rushmore… And today my wife got three letters in her name for my accounts to be payed… So they are trying to use my wife’s name as an attempt to collect on the dept. Possibly damaging her credit which she has nothing to do with…. I don’t think it is right that they misrepresented and fraudulently request payment from a person they know dies not have an account balance pending payment.
