Who is RGS Financial?

RGS Financial , Inc., is an Accounts Receivable Management (ARM) and Business Process Outsourcing (BPO) firm located in Richardson, TX. According to the Better Business Bureau (BBB), they were founded locally and incorporated in 2005. The BBB opened a file on RGS three months after their founding. In 2016, RGS was recognized as a State of Texas Historically Underutilized Woman-Owned Business. Buzzfile indicates RGS has an annual revenue of $47.8 million and a staff of 125.

Is RGS Financial a scam?

They’re legit. RGS Financial is a legitimate collection agency that offers professional services in two main areas: BPO services and ARM services. As for outsourcing, RGS offers office support in several areas, including welcome calls; surveys; loyalty programs; new production notifications; and fraud detection/prevention. Their ARM branch of services includes third-party debt collection; first-party receivables management; asset location; and consulting. RGS acts as a third-party debt collector for the automobile, health care, retail, credit card, student loan, medical, and utilities industries.

Like many contemporary collection agencies, RGS Financial’s website appears to be intended less for the average consumer and more for the large multinational corporation seeking an effective solution for past due accounts. They boast state-of-the-art security for all their transactions and a client list including corporations such as Mercedes-Benz, Nordstrom, USAA, and Bank of the West. Although RGS Financial is a member of the Association of Credit and Collection Professional (ACA); the ACA Ethics Committee; and ACA of Texas, their website does not mention any consumer protection laws such as the Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA), or the Telephone Consumer Protection Act (TCPA). Their web-based contact and online payment forms do not inform consumers of their rights under these laws.

How many complaints are there against RGS Financial?

The Better Business Bureau lists a total of 55 complaints against RGS Financial closed in the past three years, 22 of them closed in the past twelve months. Of all closed complaints, 17 of the 55 complainants indicate satisfaction with the resolution. There are also two reviews of RGS Financial—one positive and one negative. Most of the complaints against RGS result from alleged violations of the FCRA and/or FDCPA such as failure to verify debts. In 2017, there were 12 complaints alleging RGS had contacted consumers for unverified debts. Complaints that were accepted as resolved included a consumer who was receiving calls to an incorrectly assigned telephone number; a debt resulting from identity theft that appeared on a credit report; a delinquency that appeared on a credit report before the consumer had been notified of the debt; and a delinquency resulting from an error in bank account identification information. Among closed complaints still awaiting final approval by the consumer are several resulting from debts that consumers have objected to as unverified or fraudulent. Many of these complaints originate with cable companies; some of them are from banks or lending companies. Generally, RGS addresses complaints with fairly detailed documentation.

Press Releases of Lawsuits Brought On By Lemberg Law Against RGS Financial

March 17, 2017.  On behalf of our client, Lemberg Law recently filed a complaint in U.S. District Court, Southern District of Florida. The case, against RGS Financial, charges the debt collection agency with violating federal law and asks for $1,000 in statutory damages under the Fair Debt Collection Practices Act plus other relief.

I’m DEF the CPA, consumers have a right to ask that collection calls stop. Doing so doesn’t erase the debt, but it does get rid of the debt collection phone calls. Our client says that RGS Financial debt collectors start calling her. She wanted to call to stop, so she email a letter to RGS Financial telling them to stop calling me immediately RGS Financial continue to harass our client with debt collection calls.

This lawsuit charges that RGS Financial violated the Fair Debt Collection Practices Act (FDCPA) by engaging in harassing behavior and by contacting our client after having received a cease and desist letter.

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

    I just received a cal from them for the first time today and I haven’t had a call from a debt collector like this in probably close to 10 years.. I told them that the person they were looking for wasn’t available to come to the phone right now and then asked who they were and if I could take a message and she said RGS but didn’t want to at first… It literally took me a total of 3 times asking before she did and then hung up quickly saying she would try again later so I’m sure I have plenty more calls coming it sounds like. But what should I do and what should I say when they call me again? Any suggestions?

    RGS Financial are calling me literally every 3-4 hours a day. I spoke with them and told them I don’t have a job, try me back in 30 days. They have called everyday in the last week, 4-5 times a day with the exception of New Years Day and Christmas
