According to federal law, employers are allowed to ask about a person’s criminal history. However, the EEOC says that if the information is used to eliminate someone from the job pool, that decision might violate title VII of the Civil Rights Act of 1964.

U.S. law doesn’t prevent employers from deciding not to hire someone based on a criminal conviction, but several states have what are called “ban the box” laws, which limit the ability of employers you use arrest and conviction records to make decisions related to employment.
