Is Medical Data Systems a scam?

They’re legit. According to the Better Business Bureau (BBB), Medical Data Systems Inc was founded in 1988 and also uses the name, Medical Revenue Service. Buzzfile indicates that Medical Data Systems was founded in 1985, has an annual revenue of $43.8 million, and employs a staff estimated at 296.

Who does Medical Data Systems collect for?

Medical Data Systems is a third-party collection agency that focuses exclusively on collecting delinquent medical bills. They have divided their collection services into three main “lines” of service: extended business office (or early-out); primary collections; and secondary collections. Its extended business office service enables hospitals and medical facilities to send initial billing statements directly through MDS. Its primary collections service addresses delinquencies beginning at 90 days past due. Secondary collections agents not only pursue bills that remain unpaid after initial efforts to collect; they also analyze accounts for wrong numbers, bad addresses, and billing and adjustment details and provide detailed reports to creditors.

The MDS website is not written with the consumer or patient in mind. They have posted a statement that, “all collection trainers are ACA certified and our methodology is compliant with all state and federal laws and regulations, including HIPAA, FDCPA and FCRA.” However, much of the language on their site betrays their belief that medicine should be run as a for-profit business, with the well-being of patients best regarded as secondary to increased profits: the “core of [MDS is to] provide outstanding service to our client base by keeping their best interests in focus…and continually striving to push the technological envelope to grow their business success.”

Can Medical Data Systems Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely MDS would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. Can you help me file a No Fee Lawsuit against Medical Data Systems?

Absolutely. You can sue a debt collector. Here are some Sample Complaints

The BBB’s Additional Complaint Information statement indicates that MDS’ business activities have resulted in a pattern of complaints “from consumers that allege they have requested proof of debt that is being reported by Medical Data Systems on their credit report, but have not received anything; [and, in] other cases, several consumers have reported…that they were unaware of a debt that was reported by Medical Data Systems to the credit reporting agencies, or that Medical Data Systems, Inc. fails to remove reference to debt from their credit report after a debt has been satisfied.” The BBB contacted MDS directly to request cooperation in addressing these lapses. MDS responded with a general statement to the effect that all employees are trained to follow MDS’ approved collection methods in adherence with the FDCPA, but refused to acknowledge any wrongdoing. Despite their efforts to work with MDS, the BBB has reported that as of August 2017, the pattern of complaints has continued, resulting in BBB’s decision to continue monitoring the company’s performance in this area.

Medical Data Systems Calling You?

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

Can I sue MDS for harassment?

Yes. If you want to enforce your rights, or recover money for violations — you need to sue. Federal laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

Hello I have a problem with this company which basically I just realized they reported me with the credit bureau even though I’m paying the settlement they told me. Not the one that benefited me the most now that I’m reading this article is when the bell rings and understand why my credit cards submissions are declined by some “delinquent debt”. Please I need to fix this situation and if you can help me I’ll deeply grateful
