Lemon Law for Appliances

Lemon Law for Appliances

When you buy any consumer product, you expect it to work properly. You also expect it to meet accepted quality standards. It is highly frustrating to have to waste time and spend money in returning new appliances and/or vehicles to have them repaired. Unfortunately, it happens much too often, sometimes repeatedly.

If you buy a lemon, in the form of a defective appliance or faulty vehicle, the federal Magnuson-Moss lemon law can protect you. For example, your new refrigerator might not meet the quality specifications claimed by the manufacturer. If they won’t replace the appliance or give you a refund, you can probably take legal action. This will also be the case if you have to keep on taking your car in for repairs.

If you want to seek compensation from a manufacturer for a defective product, there are rules and regulations to follow. For instance, you must have a valid warranty or service contract. You must also prove that the manufacturer didn’t honor the warranty within a reasonable time. Or that the number of attempts to repair your appliance or vehicle was unacceptable.

You will also need an experienced lemon law attorney from a firm like Lemberg Law on your side.

What is the Magnuson-Moss Warranty Act?

The Magnuson-Moss Warranty Act, dubbed the federal lemon law, became law in 1975. Its aim was to protect consumers from deceptive warranty practices. More specifically, it aims to stop the widespread misuse of disclaimers and express warranties. Also known as the Consumer Product Warranty, it defines the standards of consumer product standards so that we all know what they mean.

The Act includes services contracts and a range of warranties. These include express and implied, which is a basic warranty. Implied warranties automatically cover all goods valued over a certain amount. Express warranties are clearly stated and may be in writing or verbal.

The Act states that companies must distinguish between full and limited warranties. They must also fix issues the warranty covers within a reasonable time.

While all the U.S. states also have lemon laws, most only cover defective vehicles. In any case, the Magnuson-Moss law is the foundation for state laws. Ultimately the Magnuson-Moss Warranty Act is a broader law. It takes precedence and protects all U.S. consumers in all states.

What the Magnuson-Moss Warranty Act Covers

As our lawyers will tell you, the Act covers all consumer goods with warranties. These can be anything that we use for household or personal purposes. It also covers equipment and appliances that we use or install in our homes. The key is the warranty combined with a breach by the warrantor.

While smaller items like toasters and kettles may have a warranty, the equipment and appliances lawyers will usually get involved with are larger. They include heating, ventilation, and air conditioning (HVAC) equipment, kitchen appliances like dishwashers and washer and/or dryer units, refrigerators, and stoves, cooktops, and ovens.

The Act also covers new and used vehicles, as long as there is a valid warranty. This extends to motorcycles, cars, recreational vehicles (RVs), and even mobile homes.
