Nunn v. Hyundai Motor America

Case Information

  • Case Number: 8:25-cv-01091
  • Case Status: Case in Progress
  • Court: United States District Court, Central District of California
  • Filed: May 21, 2025

Lemberg Law represents plaintiffs in a proposed class action against Hyundai Motor America. The lawsuit alleges that certain Hyundai vehicles equipped with 2.5L Smartstream GDI + MPI engines suffer from a dangerous fuel injector defect that causes stalling, loss of power, and significant safety risks.

2023 Hyundai Tucson

Complaint

The complaint asserts that 2021–2023 Hyundai Santa Fe, Sonata, Tucson, and Santa Cruz models contain defective fuel injectors that can leak internally, causing the engine to misfire or stall while driving. These failures often occur suddenly and without warning, placing drivers, passengers, and other motorists at increased risk of crashes.

Key Allegations Include:

  • Sudden Engine Stall: Vehicles shut down or lose power while driving, including at highway speeds and in traffic.
  • Persistent Misfires: Fuel injectors become stuck open, forcing repeated trips to dealerships with no permanent fix.
  • Inadequate Repairs: Hyundai allegedly continues to use the same defective part in attempted repairs.
  • Concealment: Hyundai knew about the defect prior to sale, yet did not inform consumers.
  • Widespread Impact: Thousands of complaints to dealerships and the National Highway Traffic Safety Administration (NHTSA) detail similar failures.

Manufacturer Response

Internal Hyundai records, technical service bulletins (TSBs), and consumer complaints indicate the automaker was aware of this fuel injector issue as early as 2020.

Despite numerous updates, Hyundai has not issued a formal recall and continues to supply the same flawed component, leading to repeated failures and extended repair delays.

Claims for Relief

Plaintiffs seek to hold Hyundai accountable under several Texas and federal laws, including:

  • Fraudulent Concealment
  • Unjust Enrichment
  • Breach of Implied and Express Warranty
  • Violation of the Texas Deceptive Trade Practices Act

The lawsuit requests compensation for repair costs, loss of vehicle value, and the risk posed to drivers and passengers.
