Can Fox Collection Center Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely FCC would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. Can you help me file a No Fee Lawsuit against Fox Collection Center Inc – FCS?

Absolutely. You can sue a debt collector. Here are some Sample Complaints

Complaints against Fox Collection Center commonly cite problems resulting from failure to verify debts and disputes about the accuracy of reports to the credit reporting agencies and billing documentation. In November 2017, a complainant indicated that his debt with a medical service provider was discharged in bankruptcy in November 2013. A month later, FCC, “representing the debtor, opened a collection claim against the discharged debt.” Despite the illegality of actively pursuing collection activity on debts that have been discharged in bankruptcy, the complainant stated that the “collection item still persists… on …his credit record as of the time of … the complaint, and has caused years of undue harm… which could have been prevented with basic, due diligence in FCC’s reporting.” The complainant contacted FCC in October 2017 and had not received a response. In response, Fox Collection Center indicated they “were unaware of a bankruptcy, … so they reported it as a delinquent account.” They also indicated that “now that…they are aware it is a bankrupt account …they will report it as such and update their records.” The complainant’s rebuttal indicated that she refused to accept the attempted resolution because “no update to the collection record has been made.” She will accept the resolution only when “removal of the collection and appearance of the removal on credit reporting… is done.”

In September 2017, a complainant indicated that that Fox Collection Center had refused to validate a debt despite several months of having made requests. The complainant indicated that FCC had previously claimed to have sent “some kind of release form,” but the complainant indicated she had not received anything. As a result, FCC had sent her a letter stating, “they have no choice but to believe…she is refusing to pay.” The complainant stressed that federal law requires Fox Collection Center to provide debt verification, and that that the medical provider indicated she does not owe a balance. Her insurance provider also “indicated that the procedure was covered 100% by insurance.” In response, FCC insisted that they had sent “the release that needs to be signed and returned …so they may obtain the information the complainant is requesting but to date have not received it back.” FCC also refused to make any effort to contact the insurance provider, stating that “as far as her request for all correspondence with her insurance company, she will need to contact them to get that info.”  The complainant refused to accept the attempted resolution, indicating FCC “has not sent… anything but the bill” that has been disputed; that she has “no trust in Fox collections…and will believe it when she sees it that she has a form to sign. She also doesn’t believe she should have to sign a form for them to validate the…debt.” Fox Collection Center replied by stating they had mailed another release for the complainant to sign.

Fox Collection Center FCC Calling You?

Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

Please allow Amy, the first person who contacted me from Lemberg, know how much I appreciate her efforts, kindness, and professionalism.”

“I received outstanding professionalism from the own staff. I had a horrible experience when trying to solve a debt. 1 debt collector associate said she would speak to the prosecutor’s office and another representative told me that when I called the office back he would call the police and have me arrested. I had been insulted, mocked, and threatened, and feared that the police would appear at my door any given moment.”

“I just wanted to let you know we received the check from your office on now and I wanted to take some time to inform you that we really appreciate all of your efforts in this matter.”

I had dental work done and the bill was 3000 . I paid 1300 up front and also done 100 dollars worth of work on the dentist power equipment chainsaw to help pay the debt . I got in a spot where I couldn’t pay anymore the last statement I revieved from the dentist was saying I owed 1700 dollars . Now fox collections is saying that I owe 2800 dollars . Can they charge extrA. I even offered to pay the dentist off directly. He informed me it is a federal crime if he took a payment from me now that he had turned it over to fox. Is this true???

I have a large medical bill from 2016. Last payment I made on January 10,2018 was for 1000.00. They still reported me to the credit bureau and it’s showing as derogatory. Is there a way they can remove this “derogatory” from my report.?
