Can Zenith Financial Network Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely ZFN would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. Can you help me file a No Fee Lawsuit against Zenith Financial Network?

Absolutely.  You can sue a debt collector. Here is a Sample Case Complaint:

The BBB has posted an Alert on Zenith Financial Network’s profile page warning site visitors about potential problems. The Alert states:

“BBB files contain a pattern of complaints from consumers that allege harassing phone calls using scare tactics regarding debt.

“On May 21, 2018 BBB sent correspondence to ZFN requesting their voluntary cooperation in providing steps it will implement to eliminate the pattern of customer complaints.

“On June 1st, 2018 ZFN provided the following response: ‘We deal with more than 25,000 phone calls in a week. Our representatives take verbal abuse, deal with foul language, and consumers being constantly belligerent towards them. We answer and research all complaints against this company within a timely fashion and will continue to do so. Unfortunately, as a consumer collection agency complaints are a hazard of the business. I will continue to work with our staff to try to improve on this.’

“BBB will continue to monitor and update the company’s report as needed.”

In June 2016, a complainant indicated that he had been contacted by a Zenith Financial Network representative who was “very rude and… a bit deceitful in their introduction and greeting.” The complainant stated that the first time ZFN called him, he had no idea who they were because the representative “was very rude and short with everything he said, … proceeded to indicate the client they were representing, and then immediately went into threatening tactics that if the complainant didn’t pay the balance on the account, he would be hit with legal actions.” The complainant stated that he did not “even have a chance to speak on his own behalf or explain anything… before the ZFN representative hung up on him after… indicating the complainant was taking up too much time by trying to create a dialogue about the situation.” The complainant called back and spoke to a manager, who “seemed like he would be a bit friendlier after the complainant explained what he had gone through with the first representative. But, after a minute, he started to get short and rude himself…and ultimately, that call also ended with” a hang-up. The complainant received 3 more calls, each entailing rude and aggressive misconduct followed by a hang-up, despite his insistence that “every time… he had spoken to this company he had been respectful and diplomatic.” In addition, he claimed that the ZFN representatives had failed to identify themselves and gave the impression that they were a law firm rather than a collection agency. In its response, ZFN indicated that they had closed the file and would discipline the employees responsible for the misconduct.

Zenith Financial Network Calling You?

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

Can I sue ZFN for harassment?

Yes. If you want to enforce your rights, or recover money for violations — you need to sue. Federal laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

Zenith collections are calling me constantly regarding a debt. I have not returned there calls as I know I have no debts in collections. I even pulled up my credit report and shows no collections. I got a lot of calls from a different agency for collections. I told them I owe nothing as the debt was wrote off and I am disabled and non collectable. I’m pretty sure zenith is asking about the same debt. They’ve left messages that I need to call them and set up payment arrangements and that I can be sued and taken to court. Should I even contact them ?

I was contacted by a woman who represents this company asking for a collection amount of $180. I told her this account had been paid off and closed and after reading through my credit karma report and repeatedly telling her I won’t pay this collection, she said ok and hung up. Be careful before paying any money to this collection agency, make sure you know exactly why before making a single payment. She knew I didn’t owe money, which is why she hung up so fast.

ZFN is contacting me non stop in regards to a cash loan my husband took out. I have tried to work with them but they are extremely rude and talking about suing my husband or taking us to court. I do not have the money to pay them right now and I want to make sure that my husband is not going to get in trouble for not paying them during the hardships we are facing right now.

We are currently dealing with ZFN & associates about collections from a loan. I have some concerns that they are violating our consumer rights and would like to discuss this further. Thanks, Jen
