In 2013, a judge in U.S. District Court, Northern District of Illinois, refused National Enterprise Systems motion to dismiss Deschaine vs. National Enterprise Systems for alleged violations of the Fair Debt Collection Practices Act. According to the judge’s decision, the customer alleged that National Enterprise Systems delivered a first debt collection later that failed to effectively disclose the name of the lender to whom the debt was owed. The letter supposedly identified Paragon Way as the “customer,” Precision Recovery Analytics as the “current creditor,” and GE Money Bank/JC Penney Consumer as the “original lender” The customer argued that this violated provisions of the FDCPA that prohibit false, deceptive, or misleading representation or means in connection with the collection of a debt. The judge ruled the National Enterprise Systems motion to dismiss, and allowed the case to proceed. As a company which uses automatic dialers NES may also be subject to the Telephone Consumers Protection Act.

    Got a call and a text from NES today- from an “agent” stating that I am being investigated for fraud and many other complaints and allegations that have been filed against me. Weird thing is, they are not only being misleading, but they are using a name I haven’t gone by in over 12 years. I have no idea what the debt is and was honestly worried it was a scam and didn’t call back.

    Found out my Ohio tax refund was going to be held by the Ohio Attorney General’s office. I called to find out what was going on. Was told this was a student loan from the University of Akron. I have not been enrolled at U of A for 30 years!!!! All of my loans are paid off and I had lived and worked in Ohio for over 10 years with no notice of this debt. I moved back last year, no notice. This is absolutely ridiculous.

    I have never been contacted by Lorain Community College in the past 15 years of owing them over $1800. Now all of a sudden I get this notice stating that I owe them money – the Ohio Attorney General office? I don’t think so. It’s been over 15 years and my student loans are all paid off. What gives?

    Received a debt collection letter from them saying I ow $1700 for a Synchrony Bank account #xxxx. I told them I donʻt have a CC ending with that number, nor do I have a Synchrony CC. She said there was a large purchase last year in 2018…. again, told her NOPE, NADA, NOTHING! I asked her to give me the date and the vendor (client she representing)… she then hung up on me!

    National enterprise systems stated that i owe them $17,542 and have paced this on my credit files with Trans union. This company has called and harrassed me along with UAS and Turnstile capitol management. The college i attended which is South College in knoxville Tn, have students to sign loans, then UAS send letters out stating that the loan has been sold. Next thing happens is that even while in college, they start demanding $1000 monthly then send the report to the credit bureau to destroy your credit.

    I have paid this company for many years! the original loan amount was 8600.00 with monthly payments of 62.00 I paid each month $150.00 for over 5 years and the amount never budged. I disputed the claim and and it was erased from my credit file. Now they have sent my sister (co-signed) a threatening letter and say that I owe $12,000.00

    My dad and I received a letter from NES and we don’t owe anything to anyone. Most of my debt is in Chpt 13 so I should not be receiving any collection letters for anything. They did not even give information on what the debt is for, how acquired or to who we owe. They just say answer/pay amount in 30 days or they are going to move forward with a judgement. We are sending letter back stating that we don’t owe this debt and to provide us with documentation of debt. Plus, I will be sending a copy to my Chpt 13 attorney to see if he can do anything about it. I am getting tired of these people trying to rip people off thinking if they dont give valid [roof of debt that we will pay just because they threaten us with law suits.
