Can Monarch Recovery Management Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely Monarch Recovery would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. Can you help me file a No Fee Lawsuit against Monarch Recovery Management?

Absolutely.  You can sue a debt collector. Here is a Sample Case Filed in Federal Court:

In 2019, Monarch Recovery Management, Inc. was the defendant in a proposed class action filed by a New York consumer who alleges the collection agency falsely implied that his charged-off debt was subject to interest and fees. The suit focused on a letter sent to the man in January 2018 concerning an obligation originally incurred on a Synchrony Bank account. According to the case, the letter stated, “As of the date of this letter, you owe $12074.33.” By indicating that the balance was due “as of” a certain date, the letter, the suit says, misguided the plaintiff into thinking the balance could increase at a later time. In reality, the case points out, the debt was charged-off and was no longer subject to interest and fees.

In 2014, the Fourth Circuit of the U.S. Court of Appeals affirmed a lower court ruling that Monarch Recovery Management violated the Telephone Consumer Protection Act and granted summary judgment to the consumer. In district court documents for Lynn vs. Monarch Recovery Management, it appears that the consumer alleged that the debt collector robocalled the consumer 37 times. When the consumer answered the phone, he heard a prerecorded message asking for people who did not live with the consumer. Monarch Recovery Management argued that the calls were exempt from the TCPA because it called a landline. However, the consumer alleged violation of a different TCPA provision, namely the provision prohibited robocalls without consent when the consumer is charged for the call. In this case, the consumer’s phone number was shared by a VOIP service for which he was charged. The appellate court declined to hear oral arguments, saying that the lower court’s ruling in favor of the consumer stood.

Monarch Recovery Management Calling You?

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

Consumers have reported this agency harassing them from the following numbers:

  • 215-320-0424
  • 215-613-1212
  • 800-220-0605
  • 800-441-6881

  • 855-880-6086
  • 855-880-6084
  • 855-881-0745

Can I sue MRM for harassment?

Yes. If you want to enforce your rights, or recover money for violations — you need to sue. Federal laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

Monarch keeps calling me, with only saying it is a Business matter and calling me with different numbers. I read what they are, and I am currently with Freedom Debt, which has consolidated everything that pertains to my credit. I want Monarch to stop harrising me

  • Olivia

They were calling me twice a day for about a week before l blocked them. They have tried with other numbers but is either silence or a robot call saying “this a call is in an attempt to collect a debt.” They started call my family and asking they if they knew anything about this. I get a new letter a least once a week but by the time the get here any “offers” or “must pay by dates” are past or only days away. They even started emailing me. Then I started getting these robots calls saying *unclear sounds* has filed a case against you. If you do not act now a lien will be put against you.” Then it gets fuzzy again they mention arrest and you need to press 1 now to talk to someone about your case.

I have blocked them on everything at thise point but wondering if I should let them through to show how many times they are calling and emailing.

They have also been calling me from the 844-205-2138. I pick up the phone, and they say nothing and/or hang up loudly in my ear. I am tired of since they call between 8:05 am and 8:25 am. I have 17 calls on my caller ID from this number. I will be sending them a no contact letter using the address provided here on this page. I do not owe anyone that requires a debt collector.

Monarch Recovery calls my home phone number at least two or three times a day. These are annoying hang up calls, no one speaks. This has been going on for weeks despite my sending a “stop harassing me” letter to the address listed on this site for Monarch Recovery. I have no overdue accounts that I know of and there are no overdue accounts listed on my credit score with Equifax or Trans Union. Calling home phone and my cell
