- Debt Collection Agencies: A Deep Dive
- I Reviewed 20,305+ Resurgent Capital Services Complaints. Here are the Patterns

- Resurgent Capital Services is a major debt collection company that services and collects charged-off consumer debt.
- Consumers frequently report problems involving debt ownership confusion, credit reporting, validation failures, and harassment.
- Many consumers cite the Fair Debt Collection Practices Act (FDCPA) when challenging how Resurgent handles disputes and collection activity.
My name is Sergei Lemberg, and I have practiced FDCPA law for nearly two decades. I know Resurgent Capital Services from court filings. But what about outside the courtroom? To answer that, I reviewed thousands of consumer complaints from the CFPB, along with comments posted on Google and the Better Business Bureau.
Let’s dive in.
So, Who is Resurgent Capital Services?
Resurgent Capital Services is a debt collection and recovery company that services charged-off consumer debt. My research found the company began operating in 1998. Its business address is 55 Beattie Place, Suite 110, Greenville, South Carolina 29601, and correspondence related to LVNV Funding is often sent to PO Box 10497, Greenville, South Carolina 29603.
What Consumers Keep Reporting
After reviewing thousands of CFPB complaints and consumer reviews, I found that the same issues appear repeatedly. Many consumers say they first learned of a Resurgent account when it appeared on their credit report. Others report confusion when the debt was also linked to LVNV Funding.
Common themes include:
- Disputes submitted soon after discovery
- Requests for validation or proof of ownership
- Limited or missing responses
- Accounts remaining reported during disputes
- Continued calls or letters
These issues show up consistently across the complaint data.
Here Are Some Examples
The following examples reflect common themes drawn from consumer complaints:
- “They have been calling every day from REDACTED asking me to pay this bill. Every time they call I have asked them to tell me what this debt is for and they can’t tell me unless I verify personal information and I told REDACTED I will not do that. I also asked them to send me paperwork and they didn’t do that either”.
- “I believe LVNV Funding LLC / Resurgent Capital Services has acted in violation of both federal and state consumer protection laws by attempting to collect a fraudulent or misattributed debt.”
- “Resurgent Capital Services has been reporting a debt to my credit report that does not belong to me. I have contacted them multiple times about this debt. They have not removed it and have continued to report this negative information to my credit report.”
How the FDCPA Applies to These Complaints
Once you understand what consumers report experiencing, the next question is how federal law applies. That is where the Fair Debt Collection Practices Act comes into play
Among other things, the FDCPA:
- Limits how often and when debt collectors may contact consumers
- Requires clear disclosure of the debt and the original creditor
- Gives consumers the right to request written debt validation
- Prohibits misleading, deceptive, or harassing collection tactics
- Regulates how disputed debts may be reported to credit bureaus
Many Resurgent complaints describe conduct consumers believe violates these protections.
What Consumers Can Do When Facing Resurgent
If you are contacted by Resurgent Capital Services, consumers are often advised to take several steps to protect themselves:
- Request debt validation in writing and keep copies
- Ask for documentation showing debt ownership and balance
- Keep records of phone calls, letters, and credit report changes
- Dispute inaccurate or unverified credit reporting promptly
- Avoid payment until the debt has been properly verified
- Seek legal guidance if collection or harassment continues
