Lemberg Law’s client, Sherry Fry, along with a group of other Honda customers, has filed a class action lawsuit against American Honda Motor Co., Inc. The claims stem from plaintiffs alleging that the 2023 Honda HR-V vehicles have defective, shattering rear windshields. Plaintiffs bring claims under Pennsylvania, Massachusetts, California, and Georgia law under the theories of breach of warranty, unjust enrichment, as well as the Magnuson-Moss Warranty Act.
The Complaint
The Complaint of six plaintiffs alleges that their 2023 Honda HR-V vehicles have defective rear windshields that shatter without warning. Plaintiffs claim that Honda knew about this defect but did not inform the consumers. Over one hundred drivers have reported this issue to NHTSA, and Honda’s refusal to repair or replace the defective windshields under warranty has failed to resolve the problem. Plaintiffs experienced distractions and safety concerns due to the sudden shattering of their windshields.
Numerous complaints from Class Vehicle owners have surfaced since early 2023. Owners detail experiences of rear windshield shattering. Some plaintiffs reported encountering the defect shortly after acquiring their vehicles. Instances of seeking dealership assistance occurred within days of purchase or lease. Despite acknowledging the rear windshield defect, Honda has refused to repair or replace the defective windshields under warranty. The car maker has not issued bulletins to its dealerships acknowledging the defect. Class Vehicle owners have paid hundreds or thousands of dollars for repairs.
Reports indicate that one or more manufacturing defects in the Class Vehicles can cause the rear windshield to shatter. Multiple drivers have reported that their rear windshields shattered for no reason, including while the vehicles were parked. They describe the shattering as powerful, with some incidents even occurring at highway speeds.The lawsuit also argues that the Rear Windshield Defect makes the vehicles unreasonably dangerous for consumers. The defect exposes drivers and passengers to outside elements and affects the structural integrity of the Class Vehicles.

The plaintiffs demand that Honda replace each Class Vehicle’s rear windshield free of charge. This demand applies regardless of whether the windshield has failed or the circumstances surrounding any failure.
