Can Gurstel Law Firm Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely CFS would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. In Bailor vs. Chapman Financial Services, the United States District Court for the Eastern District Court of Washington entered a judgment in favor of the plaintiff Robert Bailor against Chapman Financial Services in the amount of  $1,250.  The Court found that the practices of Chapman Financial Services were in violation the Fair Debt Collection Practices Act.

Chapman Financial Services Calling You?

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

But here’s the rub: If you want to enforce your rights, or recover money for violations — you need to sue. These laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

I received a bill from Chapman in the mail for 2 x-rays that my insurance paid I thought. So while I followed up with my insurance I paid the 2 little bills as I did not want that on my report and I was concerned as the NWSH had never billed me. I called NWSH and asked why I was sent to Collections and never notified they had no information. I let them know I had also just paid 2 payment on my medical bill and only 1 check cleared and inquired about the 2nd check. NWSH stated they did not have record of it the 2nd one but they got the other payment and my account is at 0.00 balance I said both checks were in the same envelope. I said I still owe you $1,100.00 they stated I did not as they showed a zero balance. I thought I would look online at my account number and there it is was I owed $1,100 still. I felt this was a new person? Then 2 days later I got a call from the 208 Chapman number demanding payment for just over 1K. I advised them I just paid for 2 x-rays that I was almost sure I did not owe and that was all that was on a paper bill from them and that I had been paying off my $1,100 to NWSH regularly and that they just accepted a payment so I was confused that they (NWSH) did not tell me-Yet that are accepting my payments- and that I did not get a BILL re that from Chapman like I did the x-rays. The lady stated to call back NWSH and ask for a account balance statement showing my payments and when I get that to call back. So I called requested that and I was told I had a Zero balance and they had no record of sending me to Chapman. I requested the statement. I have not received that yet, nor have I received a Bill from Chapman re the $1,100 I owe. Yet I still log onto the NWSH pay link and make my payments to the bill and it clears me card. There is a Todd who calls several times a day from chapman on a robo line and my phone kills spam calls so I only get his VM and he is a “lazy talker” and slurs his words so a call back number is never completed to call him back and he is rude. Should I call the 208 number and let them know that I am waiting for the statement they requested I get? Should I wait for a paper bill from them to know they really have collections owed? I am making payments to NWSH and cannot just pay it in full. and have paid off over 1700 towards my surgery bill already in less than a year of my surgery to the NWSH. So I am not sure if this is legit of them or not? But that Todd his tone is very rude! I would be interested in my options.

I have had negative experiences in the past with these lowlifes. They sued my ex and included my name on the papers. I was never notified and a default judgement went against me, even though they were her medical bills. They even took my wages. Now here we go again. I have had some health related issues in the last couple of years, but all charges were paid by insurance. There should have been no charges what so ever. I notified the billing offices of all docs concerned, and was assurred all was taken care of. Since that time, 7 out of probably 95 have been correctly recharged by the provider. Several months ago, collections by CFS have started showing on my credit bureau, which was clear until this. I spoke with CFS and explained all this, which they have a record of. They agent said to write a letter to them regarding this. The problem is that by writing to them, resets the time clock for them to sue. Under new laws for the frca, this practice should have been eliminated last year. How do i get them to leave me alone, take it off my credit bueau, and get them to stop charging these fees that have all ready been paid through insurance?

Chapman is on my credit file as a collection account as well as Credit First as delinquent when these accounts have been charged off for several years at least the credit first on was. Chapman is a debt that my insurance covered I think.

Hello, I have had no phone calls/no letter letting me know I even had an account. I check my credit report and I all of the sudden have a derogatory mark saying the account was created in November??? I made attempt to contact the company in which sent this to collections in the first place to let them know I was having a baby and was no longer working, that I had paid as much as I could possibly afford before my baby arrived and never even heard back. Can they actually do this? No warning, no communication, nothing. I worked so hard to get my credit score back up to what it was, and now it’s right back down in the dumps again because of this. When I had absolutely no knowledge this was even sent to collections in the first place.

I have recieved 2 calls from Chapman Financial Services in the last 6 months regarding debt collection. I am unsure if it is a scam or not because I’ve just graduated college and I don’t have a penny of debt, not even student loan debt, so I don’t know why they would be contacting me? Is it safe to ignore them?

A representative of Chapman Financial was knocking on my neighbors door and looking into their home through several windows on their porch. He was asked to leave and became rude. I advised that he needed to leave the property. When he refused to leave and continued to attempt to peep in their windows I took pictures of him and his car tag which is K362377 a white Kia SUV. I told him to leave or I would call the police. He said next time he would bring the police with him. I told him to call now. He finally left after making a smart comment

I called the Post Falls Police and they told me that they felt since they felt he was on the property for what they called a “legal purpose” they did not feel that him looking in the windows was wrong. They filed a report only after I demanded to see a supervisor. The officers denied knowing this jerk but I know they know him because he is a local process server and they do not make him follow the rules.

Chapman financial has been a true nuisance in my life. They called my employer and said it was an important matter. They skipped right past calling my cell phone and embarrassed me at work. There customer service team is downright rude and degrading. When the lady pretty much demanded I get my debt taken care of, I asked if they would do a lump sum discount. She replied we can’t do that because you have not made any payments to us. Logic says if one is willing to pay the debt off, you would try to make a deal. Instead of worrying about me making good faith payments. Anywho, that’s my story..
