Is Atlantic Recovery Solutions a scam?

They’re legit. According to the Better Business Bureau (BBB), Atlantic Recovery Solutions is a legitimate collection agency originally incorporated in December 2012 before starting in February 2013. The BBB established its profile page two months later, in April 2013. Atlantic Recovery Solutions is listed as a collection agency.

According to its website, ARS provides “financial solutions for…clients…and investors, while maintaining the highest level of professionalism and integrity in the industry.” ARS’ mission is to “help creditors liquidate consumer receivables and assist consumers in resolving their financial challenges, while carrying on a high level of professionalism…ARS recognizes each consumer’s distinct financial situation, and tries to work with them as well as their clients to come to voluntary resolutions.”

Who does Atlantic Recovery Solutions collect for?

According to their website, Atlantic Recovery Solutions clients “include financial companies, local retail and consumer merchants, housing facilities, medical institutions, bank cards, and other local merchants.” ARS professional services “include debt collections and litigation solutions.”

Their website does not provide a lot of detailed information about their business practices, stating simply that they “work with a variety of clients and produce very high liquidation and recovery rates” with a business model that “emphasizes compliance and integrity.” Litigation services in the form of “wage garnishment, civil judgments, or by default judgment… are executed by ARS’ legal network of attorneys.”

As for compliance, all Atlantic Recovery Solutions employees must complete Fair Debt Collection Practices Act (FDCPA) “training requirements and have received certification after passing an FDCPA exam. Ongoing training takes place on a quarterly basis. Furthermore, accounts and calls are monitored and recorded as a part of ARS’ compliance and training process.” However, the Consumer Resources tab only provides a link to a page on the Debt Buyers’ Association website.

In 2016, a class action lawsuit was filed against against Atlantic Recovery Solutions, LLC over its practice of allegedly leaving messages on debtors’ cellphones without properly stating that it is a debt collector calling about recovering a debt, a violation of the Fair Debt Collection Practices Act (FDCPA)

Complaints against Atlantic Recovery Solutions commonly cite hostile, rude, and aggressive conduct by telephone representatives. In November 2017, a complainant indicated that two ARS representatives had called and “threatened his wife.” The representatives indicated they were going to call the complainant’s “military chain of command and take away his clearance; … that he could get in trouble; and that it will affect his…career.” Allegedly, the representatives also threatened to “look into his wife’s account and take her… money because the complainant owed them money from his repossession.”

The complainant further alleged that Atlantic Recovery Solutions representatives were “rude and disrespectful in general…spoke over his wife and didn’t even give her information on how to go about paying the debt.” He complained that this “kind of disrespect and threat should not be allowed.” In response, ARS indicated that “after reviewing the recordings of the phone calls to the complainant we were able to determine that our representative did not follow…internal policies as far as customer service. That representative has been suspended without pay, and also he has been mandated to attend…a re-training course. Also, that representative has been removed from handling the complainant’s account.” ARS indicated further that “an arrangement was secured with our office, and the complainant’s account is considered as paid and closed.” ARS “apologized for any inconvenience that this may have caused.”

The complainant’s rebuttal indicated that he was not satisfied with the resolution. He believed “that the client who threatened to go into his wife’s account and take her money should be released from business,” and that when “a customer is being threatened with something to this extent, no pay for several days and taking a training course does not compensate for their actions. This is basically a slap on the wrist.” He believed ARS should hold itself to a higher standard. ARS responded by stating that their “internal disciplinary policy… requires only that the representative is to be suspended with no pay for 3 business days. Also, the representative has been placed on a final notice and mandated to undertake our internal re-training course on customer service.” Atlantic Recovery Solutions apologized that the complainant did not agree with their internal policies but such policies “are unable to be altered by an outside party

    Gotten constant robo-calls from this company intended for a person that I don’t know; they call from different numbers across the country to (I assume) get around phone number blocks. Even if they reach the intended creditor, robocalls are a clear violation of the Telephone Consumer Protection Act. Finally called their number and got myself off the list–I’m hoping they won’t now start harassing family/friends of whoever they were calling about.

    I am being harassed by this company for a person that has the same first and last name as myself. I have contacted them and once I prove I am not the same person they are looking for they say they will remove my phone numbers. They call both my cell and my landline. They have not removed my numbers like they said they would last week as I received 2 more calls today.
    This company by harassing me have caused me a hardship within my home and marriage.

    I have never gotten once piece of mail or request for this ‘past due’ amount I owe from 2013! My sister called me telling me she got this voicemail that was threatening to take me to court in Orange County for it. I called and they said yeah it’s you, you live in ______ California. I have never lived in that state. The operator was super intimidating and rude, telling me I was giving him the run around when I was trying to get more information amount the dates, amounts , etc and proceeded to threaten me to get a lawyer and hung up on me. Is this real? I was terrified.

    I received 3 calls today along from ARS. The 2nd one came in at my job as I was listening to the voicemail on my phone. The caller clearly stated that my Social Security number was in jeopardy and that I needed to contact them immediately. I told him on the phone at my job, that I am requesting that they do not call me there, I could get in trouble. He said he didn’t care, that he was going to contact home office to verify employment and start garnishment if I didn’t respond by 4pm, that he would proceed forward. That he understood why they were doing this since I wasn’t working with them

    I had a man from Atlantic Recovery Solutions by the name of Philip Arbor call and leave a message on my sister’s cell phone. I called him back and after explaining what this debt was, he mentioned I could possibly be sued or serve time. Needless to say, the conversation did not go well. Can they do this?

    Hello, good afternoon yes i been having this call from this company call atlantic recovery group.They have leavt me a massage on my cell stating that i need to call them as soon possiable call them beacuse i have a complain on me from a crediter that i took a personal loan from 792.00 and the crediter want thier money who made complaint on me if i dont call that they were going to submit me with court paper to go to court to solve this issued if they submit this paper to court that i was going to pay attonery and court fee about $3000.00.They told me if i want i could settle this issued outside of court. I told them that i dont have 792.00 to pay them for wright know.i also told them that i went in bankcrupie on 2013 they told yes that they know because that they pull out my account.they new everything about me without me telling anything about me to
    the customer service person who took my phone call.The person that talk to she told me i want to help you out told me how much can i pay so she could talk to crediter that have the complain toward to me.so i told her that i could pay is three hundreth dollar. so she told me okay i will put this on your account that you willing to settle to pay the three hundreth dollar.Next month so i ask can you give me thier address or thier e-mail so i can make these payment she told me that they dont have wesite for me to go an make these payment that she was going to connect me with the department that handle the payment. So i told okay connect me to that department.She connect me with that department i got another who also i had all my information about me. So i told that person if they could give me a address or websit so i can make this payment he told me that dont have a website so i could make this payment.What they take credit card or debit card to make payment.Now the person that spoke with me on thepayment departmet told if i can give him fivty dollar so he can stop the process of the paper work going to my county court.to get summon he also told if i got a court paper through mail i told him that i never got paper from the court any summons.What i want to know if this company is legit or its a scam.Because is this company i have the money to pay the fivty dollar to stop my process of the paper going to court.i dont want to go to jail. To my best of my knowledge i have but all my creditor in my bankcrupies in 2013. but they saying i did not put them in my bankrupies the creditor that have the complain on me. i also ask them who was the creditor who has the complaint on they some online personal loan company who is affiliated with amscot, usa today,etc. Please i am worry about this issued but before i pay them i just want to make sure it not a scam.     I have been contacted several times by ARS. They have left quite a bit of information on my voicemail. I spoke with them on September 18th. I verified my phone number and address. I also let them know I am on disability and currently not working and I have retained an attorney to file bankruptcy. They were unable to tell me who the original creditor is and said the debt ($900) is from 2013! They also stated they have a New York address as well as my current address. I am in California and have lived here my entire life. The final straw is them calling my family. They called my mother twice. Leaving a message once and speaking to her the other time. They told my mom it was regarding a pending court date related to allegations of financial fraud. This morning at 7:40 they called my sister. They left a message stating “this number is listed as a reference or contact” for me. My sister has only had her current number for 2 years- 3 years after the original date of the debt. They also left too much information on her voicemail. As far as I can tell they have broken several laws. I truly do not think this is my debt. I have never received anything by mail and there is nothing close to the amount on my credit report.

    Atlantic Recovery Group has called me numerous times in the past few weeks, threatening some sort of litigation and each time, the message says that it’s the final notice…yet they keep calling. And they state that they’ll be getting my current address from somewhere to deliver some documents. The don’t even address me by the proper name, which makes me question their validity, and they never say exactly what they are calling for. I have never gotten any documents, by mail or “delivery” or otherwise. I left a message with them today to stop calling me and to mail whatever they need to mail me. We’ll see if that helps!

    Spoke to a guy from ARS this morning claiming we would habe to go to court if I didn’t either pay a lump sum in three weeks or make huge monthly payments.. after being I timidated and choosing the lump sum, I called back and asked if I could do payments instead because I didn’t even get the chance to talk to my fiance and we can’t afford the lump sum. The guy said no, and they have me recorded agreeing to the lump sum so there’s no turning back. Is this true? Because I’m not going to be able to pay my bills or eat foe the next month.
