Is Blitt & Gaines a scam?

They’re legit. Blitt & Gaines is a legitimate debt collection firm with an extensive history of harassing consumers over debts. B&G says that its company philosophy is “Collect Compliantly, Litigate Ethically, Lead Effectively, and Expect Excellence.” This company not only helps creditors take consumers to court, but it also directly engages in debt collection practices outside of court. In what it calls “pre-suit collections,” B&G functions much like any debt collection agency, sending collection letters, running skip tracing, and making repeated telephone calls to consumers.

If you’ve suffered from B&G debt harassment, you do have options. Under the law you can recover up to $1,000 for violations of the FDCPA, and $500 to $1,500 for each cell phone robocall.

Blitt & Gaines Calling You?

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

Can I sue B&G for harassment?

Yes. If you want to enforce your rights, or recover money for violations — you need to sue. Federal laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

that they are trying to collect a debt that is no longer collectable

These are not honest people and lawyers. Sent Payment in on time… 6 days ahead of the due date March 10th, 2023 for a March 16th Court and payment date.. Now Comes – Attorney Mary S. Choi, MBE# 45086 had to lie to get the Default Decision. Mae Sanchez gets easily frustrated when you call in and ask relevant questions. Try to line up 4 or 5 good questions when calling and listen to the polite rush to get you off the phone, But do not go … ask another question.

Blitt and Gaines took over $5000 from my checking account, which froze my bank account and doubled the amount taken from my bank. I barely had $100 in my account. They took money I didn’t have. I made payments to them when I could but missed some due to being a single mom, living paycheck to paycheck. How is this legal, taking money from my bank, money that I don’t even have? And when paying on the debt, they would add interest every day it wasn’t paid off in full, which means I would have never been able to pay it off anyway since I never have that kind of money. How can they do this to someone who already struggles to make a living? The loan was from 5 years ago.

  • Jackie

I don’t know what this is .Blitt&gaines just start taking money out my check without letting me know or sending any mail to give me an update I don’t know why ..

Blitt and gains calls repeatedly 2-3 times back to back. I called them back to ask why they hadn’t been taking the money from the original payment plan, well the info was input wrong so I regave the info and she said” you can make a payment now but if you don’t pay over $300 then it won’t matter and we will still go to court” well then why would I pay you at all if it doesn’t help I gave them the opportunity to collect the debt. They pretty much refused over 50-75 dollars wasn’t enough at the time or per month. Well i can’t even afford that but I’m trying to pay my debts. I think they should have to accept what I have to offer rather than waste the courts time and be harsh

Why are they allowed to obtain garnishment powers for a debt that is well over 10 years old? It does not even appear on any credit reports. Someone needs to put them OUT OF BUSINESS. They are the low life of attorneys. They obviously can’t get real legal jobs. I wonder if their attorneys have even passed the bar?

  • Reynato F

i paid off the debt through garnishment and Blitt and Gaines sent another letter to ADP saying i still owed $161 more.

  • janet

Blitt gains pc collections ,added garnishment to my salary where they listed them selves as the next one on the line to take 15% out of my check, where the first one is my student loan as you all know student loan with debt collection it mean there will be no next on the line becuase the student loan is big
so the damage i ran to is 75$ was monthly fees pulled out of my check becuase they put garnishment that pull zero money and yet they added their lawyer fees and services ,where i end up paying fifty fifty of my check to debt collection that just went fees and services.so yes if they knew they are next in the line why did garnish me for 8 months, and more funny story they keep their eyes on my profile and keep trying to garnish me where i dont have job any more so all what they want is 2800 and i lost 30k just fees and services and interst rate (student loan interest rate and 3 granishment) where yes they shouldnt join garnishement on my check if they were the next after student loan as if debt collection on my student loan is not drying me with fees and services and offset

I was served today with papers by Blitt & Gaines on a debt (June 17, 2010) which was originally a judgment on my credit report. It appears they are trying to revive it again. But I disputed it given it was over seven years old at the time I disputed it and it was taken off of my credit report. Furthermore, this discover bank credit card debt was not my causing. A credit card was opened under my name without my consent and I was not aware it was opened and charged at the time. Help would be very appreciated to fight this in any way!

Blitt and Gaines has frozen my bank account and my son’s account because I am a listed party. I have called the office many times to resolve this issue. I have been hung up on, transferred and disconnected. I have been able to speak to someone once and was told the freeze on my account will not get lifted for weeks.
I asked what my options were and they said we can request a turnover for the funds identified from the bank answer, but she can only put in the request and it is handled by another. They are holding my bank account and putting me in financial crisis. I feel like I am being screwed initially and this is not a professional business! Of course it is holiday season and now all my bills are past due and defaulted because of this freeze.

I am having money garnished from my paychecks. And I was never notifed or served any papers by mail or in person regarding this garnishment. Now they are taking out almost $300 per check and not leaving me any money for my other bills. How can I fight and beat this?

  • Rosa

These people garnished my check for a debit I can’t even remember is there any way I can stop the garnishment?

  • Mr. J

I’m dealing with these people right now for a credit card bill my ex wife set up in my name years after our divorce. I told them that it was fraud and gave them details. My ex now decides she wants to pay the bill and that she called them and was told that I have to give them permission to speak to her. I called them and they said they couldn’t speak to me either now. I even asked them some questions about the fraud paperwork that I was to fill out and they refused to speak to me about it. I told them it’s kind of hard to file a fraud claim through their office if they will not explain their form to me and the time frame that I have to have it submitted. I sent them an email on their site last night asking someone to contact me or to give me a contact number for someone that will speak to me….have not gotten a response as of yet. Strange way to run a business in my opinion.

Blitt & Gaines PC supposedly bought all my closed charged off account from when I lost my job in 2014. They took me to court for Fingerhut. I called Fingerhut and they don’t know anything about it only that the account is charged off. The judge wouldn’t listen to anything I had to say. The entire courtroom was Midland funding Lic and Portfolio recovery cases and Blitt & Gaines PC are their fake attorneys. I live in Illinois

  • Sher R

Blitt & Gaines obtained a judgement against me. I was never served to show up to court. I never received any paperwork from them or the county courthouse. Now I am having my wages garnished from a debt in 2007 that my former boyfriend created in my name. $660 a month is the garnishment amount and I’m about to lose my house. Is there anything at this point I can do? I live in Illinois.
