In 2015, a judge in U.S. District Court, District of New Jersey, refused ARS National Services motion to dismiss Park vs. ARS National Services for alleged violations of the Fair Debt Collection Practices Act. According to the judge’s conclusion, ARS National Services delivered the customer four debt collection letters from window envelopes which revealed the customer’s account number embedded in a barcode. The customer claimed that this was a violation of the FDCPA’s prohibition on using any language or symbol on an envelope besides the debt collection agency’s speech. ARS National Services argued that, since the account number was embedded in a barcode, it was a “benign symbol” exempt from the FDCPA. Drawing on legal precedent that determined that a real account number visible through a window envelope was an FDCPA violation, the judge was not persuaded by ARS National Services’ debate, and allowed the case to proceed.

December 28, 2015.On November 2, 2015, the U.S. District Court, Western District of Pennsylvania, denied a motion from ARS National Services for judgment on the pleadings (Link vs. ARS National Services, No. 15-643) alleging that ARS National Services violated the Fair Debt Collection Practices Act (FDCPA).
The case centers on an envelope that ARS National Services sent Ms. Link. ARS National Services sent Ms. Link a collection letter that had a barcode on the outside of the envelope. When the barcode was scanned with the proper device or a smartphone camera, an account number connected to Ms. Link was revealed.
ARS National Services moved for judgment on the pleadings. This means the court should dismiss the case if it found that there was no dispute between the parties about the material facts and it was not possible for Ms. Link’s assertions to constitute a violation under the FDCPA even if everything she claimed was true. Since the material facts were undisputed it came down to whether or not the barcode on the outside of the envelope violated the FDCPA.
ARS National Services argued that the barcode did not violate the FDCPA because it fit into the law’s “benign language” exception since the only information that could be gleaned from it was an internal account number. The court disagreed and relied on language in the FDCPA saying it should be broadly construed, and the potential harm the disclosure could cause. A binding case requires that the court look at the potential of the information to identify the debtor. Since the account number is directly tied to Ms. Link, it is therefore possible for her identity to be found out from the barcode.
For the above reasons the judge denied ARS National Service’s motion for judgment on the pleadings, and Ms. Link’s case alleging FDCPA violations can more forward.

ARS has been calling family and friends. I have not received a phone call from them. I am current on all my bills and have no clue what the issue is. They have not sent any mail with any information. My credit report is not showing anything involving ARs. They have been harassing my family and friends looking for me for the last month and still have not reached out to me. They call them several times a day leaving threatening messages if I do not call the guy back. Why would a company not reach out to me if it’s me they are looking for? My family is tired of it and how do they even get friends and family members phone numbers? How do I get it to stop?

The last call i received was from 717-614-8244 today stating they are about to make final decisions on a debt i have no knowledge of. The have never sent me documentation about the case they are claiming and i don’t even know what debt they are trying to collect. I usually don’t like answering calls from Collection agencies because they are so annoying and tell to harrass people. If it was serious, they would have at least sent me a letter in the email with details of the case. They have even gone to the extend of trying to figure out my friends and calling debt about this case-this is crazy!

ARS is non stop!! Im so sick of the constant calls from them threatening to sue me, ect they are trying to collect over 700 dollars on an account that was under 300 its insane, they have called me over 15 times in the last month or so, they went as far as figuring out who i was married to and calling him. How i have no idea!! I’ve told them id like to make payments they refuse and say it needs to be in full, i say im unable do to being unemployed and then they go and put my so called “file” as a refusal!! Im so sick of this!!

A have several collections accounts from ARS, but I have been working on my credit for almost a year and have most of them removed, however one collection is for my daughter when she was 1, she in now 4. Anyhow they keep reporting the account as verified, so I called the hospital, and they themselves or any surrounding clinics can not find my daughter being there 11/12/17, they do have her there 11/16/17 which was paid, so I then called Medicaid they do have an attempt to collect a debt on that date from someone, but she was not covered until the next day. My question is how can they verify the debt, if the hospital can not even verify she was there?

They claim to have mailed me documentation, which is not true. I have no account with this company and they do not state who they represent. I have received NO written information either. They have not looked up my boyfriend’s phone number and are calling him leaving the same threatening voicemail. This seems to be a violation and I would like to pursue legal action against them.
