In McColloguh vs. Johnson, Rodenburg & Lauinger, LLC, the United States Court of Appeals for the Ninth Circuit upheld a judgment of $311,000.00 in favor of the plaintiff, Timothy McCollough. McCollough’s old credit card debts in the amount of $3,816 were sold to CACV of Colorado who then sued McCollough in 2005. McCollough argued that the statute of limitations had expired on collection of the debt. Despite this being correct, CACV of Colorado falsely told the law firm representing it that McCollough had made a payment in 2004 that extended the statute of limitations. The suit against McCollough was later dismissed and he then sued the law firm representing CACV of Colorado and obtained a judgment in the amount of $311,000.
