A Summary of Your Rights Under the FCRA

You have a number of rights pertaining to background checks. For example, you have the right to know if an employer uses information from a background check against you. You also have the right to refuse a background check. In order to request that PSI conduct a background check, the employer must obtain your express written consent.

This is all by way of saying that PSI cannot hand over your information to an employer unless four conditions are met: 1) the employer has given you a standalone document that indicates the employer might conduct a background check; 2) the employer has your written authorization to conduct a background check; 3) the employer says that it will provide you with advance notice if they are going to take an adverse action based on your background report; and 4) if an adverse action is taken, the employer will supply you with a copy of the report and a summary of your rights under the FCRA.

Your Right to a Mistake-Free and Legally-Compliant Report From Professional Screening & Information Inc or PSI

Under the law, PSI is required to take reasonable steps to ensure its report is as accurate as possible.

The Fair Credit Reporting Act limits the kinds of negative information a background check report can include. For example, a background report can’t list old items, such as civil suits, judgments, arrest records, paid tax liens, and debt collection accounts that are more than seven years old. It can’t list a bankruptcy that is more than 10 years old. The only type of old item a background report can list is a criminal conviction – but not a conviction that has been expunged.
