Prime Recovery Services , LLC (PRS) is a third-party collection agency based in Texas that specializes in collecting delinquent education loans. Is Prime Recovery Services a scam?

The Better Business Bureau (BBB) established a profile page for Prime Recovery Services in 2016, but it does not provide a lot of detailed information about PRS’s founding date or other business details. The BBB lists PRS as a collection agency. Neither Buzzfile nor Manta has established a profile page for PRS.

According to its website, PRS “is the premier company for all …collection and legal services involving …delinquent accounts.” PRS is “focused on providing collection services with the highest levels of customer satisfaction…and will do everything… to meet client expectations.”

Prime Recovery Services collects delinquent debts for a specialized niche market. Specifically, they “have been providing…services to over 150 trade schools, universities, and law offices for over 10 years.” PRS is a full-service agency that offers “collections, skip tracing, credit reporting, legal services, and judgments.”

PRS works “accounts extensively to insure the best results for… clients… at a lower rate than the industry standard. PRS’s collection staff “send out collection notices…place all accounts on the debtors’ credit reports, skip trace …accounts to insure… maximum contact, …and in some cases… offer legal services to secure judgments on behalf of… clients.”

Prime Recovery Services states that its “representatives have a minimum of three years of experience… and are required to follow all state and federal guidelines in the collections industry to insure proper representation of… clients” and of PRS. However, the PRS website does not provide any detailed information about its training or regulatory compliance polices, and there are no links or references to consumer protection resources, laws, or enforcement agencies.

How many Complaints are there against Prime Recovery Services?

As of October 2019, the BBB has given PRS a rating of F, citing their failure to either respond to or resolve many complaints. The BBB closed 9 complaints against Prime Recovery Services in the preceding three years, with 1 complaint closed in the previous 12 months. Complaints are fairly evenly split between those citing problems with billing and collections and those citing problems with customer service. As of July 2019, the Consumer Financial Protection Bureau (CFPB) has closed 2 complaints against PRS. Justia has not listed any complaint data about PRS.

Absolutely.  You can sue a debt collector. Here is a Sample Case Complaint:

Complaints against Prime Recovery Services cite problems resulting from allegations of harassment, abuse, and suspected fraud. In January 2018, a complainant stated that PRS had “been …harassing him and…claims he did not send in all his payments even though he had sent copies of money orders and delivery receipts.” According to the complainant he had begun making payments of $200 per month about a year previously, according to an agreement in which he would send payments “by the 19th of each month along with the tracking number to show payment is on the way.” The complainant said that he had developed “extensive medical issues” but still made an effort to send payments to their office, “including tracking numbers and information so PRS knew of any delay.” Allegedly, PRS “called him a liar and has been rude throughout the past year.” The complainant said that his “financial situation has changed drastically but he still does his best to make payments.” Regardless, the PRS representative assigned to his claim was “constantly calling him a liar and calls him pathetic and that his excuses are pathetic.” The complainant said he had “gone to the extreme of sending him a copy of the notice for his medical leave he had submitted to his job,” but the PRS representative continued to threaten that he is “going to tell the litigation team to have his wages garnished so his payments are received on time.” In addition, “on more than one occasion he lectured him on how people like him get used to not paying bills and tend to not pay even if there is an arrangement.” The PRS representative confirmed all the previous payments the complainant had sent in, but misreported the total amount of all payments to date and threatened “to pursue wage garnishment.” The complainant stated that the PRS representative “should not be allowed to work with people since he lacks… people skills” and requested that “all his payments be credited to his account correctly.”

In February 2018, a company who had hired Prime Recovery Services to collect delinquent debts for them complained that PRS was withholding thousands of dollars in delinquent funds. According to the complainant, they had “verified with the debtors whom PRS had pursued on their behalf” that the debt had been collected. Allegedly, PRS “said they were sending the complainant’s portion of the collected amount,” but they never did. Now, PRS was “refusing to communicate with” the complainant. In addition, the complainant had done some research and “found that PRS has no real physical office or location,” and that their “website is untraceable via Whois.” They believed PRS was “farming out accounts to lawyers,” and that the “Texas Bar Association should be contacted because they are running a fraudulent operation and…should be…turned over to the Attorney General.”

The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

But here’s the rub: If you want to enforce your rights, or recover money for violations — you need to sue. These laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.
