A Summary of Your Rights Under the FCRA

Disclosure and consent are cornerstones of the Fair Credit Reporting Act. When it comes to disclosure, an employer must provide you with a standalone authorization in order to obtain a background report. This means that the information can’t be buried in fine print or tacked onto a job application. When it comes to consent, the employer must get your authorization prior to ordering an employment background check.

The employer might ask a company like PreciseCheck to run one or a variety of types of background checks. PreciseCheck may, for example, check your prior employment and education, or it may dig into your history with the legal or criminal justice worlds. It’s important to know that the FCRA requires an employer to attest to a background check company that the employer has met the disclosure and consent provisions of the law.     I recently was provided a job offer and the employer required a background check for me. I submitted my information through precisecheck.com and the next day I got an erroneous report stating I had criminal charges at the county level. I investigated this with my court records office and found out the precise check had associated me with another person with my name but of course a different birthdate. However on the report they submitted they had my social my birthdate and all of my information tied to this criminal record making my credibility questionable. At this point I have not hear back from the employer and I concerned I have lost the offer since Precise check sent incorrect information with the same criminal charges AGAIN to the same employer.
