In 2016, a judge in U.S. District Court, Eastern District of New York, denied ONLINE Information Services’ motion to dismiss Lande vs. ONLINE Information Services for alleged violations of the Fair Debt Collection Practices Act. According to the judge’s decision, the consumer claimed that ONLINE called him and left a prerecorded message on his answering machine that identified the caller as a debt collector and that the call was an attempt to collect a debt. The consumer stated that the outgoing message on the answering machine indicated that multiple people in the house used that telephone number, and that the message – which could be heard by anyone – was a violation of the FDCPA’s prohibition against communicating debt-related information to third parties. ONLINE Information Services argued that the voicemail warned the consumer to listen to the information in private and instructed third parties to stop listening before the content of the message was revealed. The court’s opinion pointed out that this didn’t protect a debt collector from liability, and also rejected ONLINE Information Services’ other arguments. The court ruled against the debt collection agency’s motion to dismiss the case, and allowed it to move forward.

    I have 4 accounts according to them, 2 of them for the exact same amount. I have been paying on my hospital bill to another collector at the rate of $167, so where did these charges come from? Why are there four of them, and two for the exact same amount? I do not think these debts are associated with me.

    I am a disabled veteran. I was hospitalized, and almost killed by hospitals. I was moved to 3 different hospitals, I was overdosed 3 times to the point of death by them, and in ICU almost a month. A ventilator was forced on me against my will, while conscious, and me telling them it was hurting me horribly. BEGGING them to remove it? It collapsed my lungs I still believe, but they deny this was the cause. I walked in on my own, and ended up unable to even walk in an induced coma that I awoke from apparently “out of it in shock”. I tore everything out, and damaged myself a great degree due to this torture. I partially started recalling much I had blocked weeks later. I had blocked much out. It was so traumatic. Now they want me to pay money for this living hell I experienced? The VA approved me going to the hospital, but did not pay all the bills. Now this company is harrassing me for money to pay my torturers? I have no insurance, and cannot afford parts B,C, &D of medicare, or co-payments. Part A pays pretty much nothing? This company is calling me, refusing to identify themselves, or what they want, yet demand to speak to me soliciting information without saying why, or who they are? Yet I KNOW it is over these hospital bills. I had to reseach online to find out who they are even. I live below poverty level, and am buried in debt til I die making payments for things purchased for the home on high charge credit that I cannot afford. But it is the only credit I can get due to hospital bills, and people like this. My life, my comfort down through my ill years, and now finally my health are ruined for these types of reasons. By people like this? Over hospital bills I realistically cannot pay…… These people are rude, and harrassing. Can I get them removed from my credit report, and my home phone I never authorized them to have without needing a lawyers fees added to my nightmare? I cannot afford a lawyer. Much less afford to pay off hospital debts I never agreed to pay? Unless they tricked me into signing agreements while I was partially [out of it]. Fighting to breath against a horribly painful machine against my will? While being overdosed repeatedly, and treated badly by at least the first hospital for sure? Only the 3rd one actually helped me that I know of? My quality of life has been completely diminished to practically living hell due to these occurances I cannot prove. Now I need pay for it as well, and be harrassed til I do?
