HelloFreshTCPASettlement – The lawsuit alleges that Hello Fresh violated the Telephone Consumer Protection Act (TCPA) by placing telemarketing calls to wireless phone numbers without the recipients’ prior express written consent.

What’s Grace Murray v. Grocery Delivery E-Services USA, Inc. TCPA Class Action Settlement?

A settlement has been proposed in a class action lawsuit pending in the U.S. District Court for the District of Massachusetts titled Grace Murray v. Grocery Delivery E-Services USA, Inc., Case No. 19-12608-WGY The case was filed against HelloFresh by people  who said that HelloFresh made unsolicited automated telemarketing calls, called numbers on the National Do Not Call Registry (“NDNCR”) and called numbers that had asked to no longer receive calls. HelloFresh denies wrongdoing and liability, and both sides disagreed on how much, if anything, the Class could have recovered after trial.

What Relief does the Settlement Provide?

The Settlement provides $14,000,000 to pay: (1) claims of eligible Settlement Class Members; (2) a Fees, Costs, and Expenses Award to Settlement Class Counsel; (3) a Service Payment to Plaintiffs; and (4) costs of Settlement administration and notice.  If you are a Settlement Class Member, you are eligible to receive a share of the Settlement.  It is currently estimated that Class Members who timely and validly file a claim may receive approximately $30–$50.

If you chose NOT TO OPT OUT you are entitled to only the amount estimated above. However, you have the right to get out of this SETTLEMENT and get MORE MONEY!!

I am on the National Do Not Call List and received a notice via mail about this lawsuit with a claim number as follows: GYU-12877782501-242072 notice was allowed by a federal court order. I would like to opt out of Hello Fresh lawsuit and seek more in damages if possible. I also receive other phone calls both robot and otherwise from other companies such as Marriott telling me that I won a family vacation for only taxes. I am on the National Do Not Call List and receive so many phone calls everyday that I never answer my cell phone anymore. How can I go after other companies besides Hello Fresh? Please help. Thank-You!
