Can you help me file a No Fee Lawsuit against FH Cann & Associates?

Absolutely.  You can sue a debt collector. Here are some Sample Complaints

Complaints against F.H. Cann & Associates commonly cite problems resulting from poor accounting and billing documentation, as well as poor communication tactics. In November 2017, a complainant indicated he had been trying to resolve a student loan debt that had been sent to FHC for collection. To avoid wage garnishment, the complainant sent several income statements, and FHC had been deducting payments from his checking account for about 6 months. For some reason, the automatic withdrawals stopped, so the complainant contacted FHC to find out what the problem was FHC  indicated they wanted the complainant to fill out additional paperwork because they had calculated his earnings incorrectly. The FHC representative asked how the complainant would like to be contacted, and he indicated his preference for email. The FHC representative indicated they would forward the required paperwork within 10 minutes, but the complainant never received it. He continued making inquiries via email, and has documentation showing his messages were read, but as of the date of the complaint, he had not heard anything further. He is concerned that his diligence in trying to repay the loan is being complicated with delays that will increase interest and costs associated with the loan.

In response, F.H. Cann & Associates indicated that despite previous communication, they were unable to “provide the Financial Disclosure Statement form via email.” However, they assured him they had sent it by postal mail. They also indicated that the representative he had spoken with had not been informed about their policy preventing sending financial documentation via email. They also indicated they had made an attempt to call the complainant to confirm that he had received the forms that had been sent by postal mail but had been unable to reach him. The complainant rejected this attempted resolution, indicating he had specifically agreed with FHC to communicate only via email precisely because of past communication and documentation errors, and had followed the directions they had supplied to ensure they had his signed disclosure allowing email communication. His attempts at communicating via fax were also unsuccessful, and although he had a record of their phone call, they had failed to leave a voicemail message. He concluded by stating his frustration with F.H. Cann & Associates’ failure to fulfill its responsibilities, all of which was resulting in increased “collection costs” that were being tacked onto his loan.

FH Cann & Associates is the worst!! Like all the other comments/complaints this company just sucks you dry. I got a call from FH Cann telling me that my student loan was to default. They said they could put me in the Rehabilitation Program and after 9 monthly payments I’d be out of default. Awesome, right! NO they are the most difficult people to work with. I only make around $1,000 a month so they had me complete their Income and Expense form to come up with a monthly payment I can afford. (was told that it would be anywhere from $10-$35 month) I told them that I could pay $100.00 month. This is the part that is such BULL!!!!!! They want total income for every person that lives in your household!!! So their taking my income and my roommates income and using that amount to figure what my monthly payment should be. $450.00 a month!! I told them there was no way I could do that. So now It’s been six months of constant crap from them only to have tons more interest and collection fees added to me loan!!! (over $7,000 in fees which they told me would not be added if I did this program) But NONE of the payment I made have been deducted. They said that money is in like a holding tank until they get the information they want. I JUST DON’T GET HOW they can add another person income to mine to come up with my payment amount!! My roommates not gonna give me money to pay back my loan. THE EMAIL ISSUE!! FH Cann said that they could only email me if i sign a 4506-T form which gives them the right to contact the IRS to get any information on my tax returns and take my tax refund. I’m totally at the end of my rope. I only owed $25,000 and now with FH CANN involved… i owe over $40,000!!!! I hate to keep giving them money when their not posting it to my loan. IT’S DEFINITELY NOT RIGHT 🙁

My loan has been in default for a long time and I have been in wage garnishment for about a year. I stayed in garnishment even though I couldn’t afford it because I did not want to talk to anyone there.
In the past, I have worked with incredibly rude people who would not listen to me at all. It was so frustrating. Today, I got up the nerve to call and was connected to Carlos A.

He listened to me and helped me to come up with a solution. Words cannot explain how horrible this has been so to have someone truly help me was a relief.

I just wanted to let you know he is amazing and so professional, it was a joy to work with him. I feel so relieved and it is all because of him. People always say when they have bad customer service, but I wanted to take this opportunity to share my wonderful experience.

    Sincerely,
    Christina S.

My student loans have been transfered to FH Cann and Associates. I have been in contact with them as they were supposed to send out a wage garnishment to my employer. I contacted them September 11th to stop garnishment due to the fact that my wages and housing arrangements would not support their garnishments. They replied that they would be sending me the Wage Garnishment Hearing Request form 36. It is now October 11th and I still have yet to receive that form and a week after I was in contact with them they sent my employer the garnishment. I called them today to find out where the papers were and they said it was sent out September 12th. They replied that they would send out ANOTHER form for me to fill out. I called back asking if there was a form I could just print off of the computer or if they could just email it to me so that I can get it done faster, and they replied, sorry you have to call this number to be directed to that form we can only mail it by mail. I called the number they gave me, 1-800-624-3115, and it was the US. Department of Education. That number then says that I have to call 1-877-677-9126, which put me right back to FH Cann and Associates. It is a run around circle and they keep calling from different numbers even after I am trying to fix the issue. No one wants to help and they wont get me the information I need to be able to get help. They just sent out the garnishment and that was that. I have 9 people living in my home, me, my husband, and our 7 children. I can not afford to go back and forth only to end up on the streets because they do not want to send me the information required by law to stop garnishment due to Economic Hardship. They call all hours of the day and have been in contact with my employers. I NEED HELP. The forms to contact this law firm will not let me send a request.

F.H. Cann is trying to garnish my wages for a Perkins loan that I have documentation that proves that I am not liable for. They are trying to collect on a debt that the school provided I do not owe considering the loan they are trying to collect on was taken out AFTER I had already exited the school a year earlier.

  • Jared

So I just got a statement from them, and they are charging me 20% of the initial loan amount as a collection fee. Nearly $5,000. They said paying off the loan in full wouldn’t take the default judgment off of my credit report, only if I repaid the monthly 10 month repayment plan to bring my debt back into good standing would they take it off my credit report all the while accruing more interest on the loan. This is extortion!

This place doesn’t even deserve to have a one star rating. They have no idea how people feel when they can’t pay their bills. Student loans in this country are ridiculous to try to repay. Back in Oct I contacted F.H. Cann after receiving paperwork from their office. I was told to contact the owner of my loan, which I did, to fill out paperwork to try to get my loan discharged since the school I went to got discredited, and now basically the “DEGREE” I have is USELESS. So I contacted them. Well in Feb, after not hearing a word from F.H. Cann for 4 months, contacts me and has added $8000 for “COLLECTION FEES” when I didn’t hear a peep out of them since Oct. I was under the assumption they were taking care of the paperwork..well they were just waiting to tag an extra $8000. So I got on track and filled out and sent them all the paperwork they wanted to get back on track in Feb. 2019. Everything was OK, because I was paying them $300/month waiting on my Income Driven Repayment paperwork to go through. All is good right?? NO! In April I see a garnishment taken out of my paycheck so I called F.H. Cann and they said they didn’t have all the paperwork. Which was (is) Bullshit. I had all the emails I had sent back in Feb with all the paperwork they asked for. They said they tried contacting me in Feb, which they NEVER did. I asked why they didn’t leave a voicemail, there answer, “We didn’t have your permission” What a Bull shit cover up. So now that conversation took place on April 12th. They said they would call back Monday after they looked at the ORIGINAL paperwork which I had resent to them. So Monday comes and no phone call, so at 12:30 PM on 4/15 I called and talked to Tyron (not sure on spelling). He says, “Oh I just got in the office at noon and was going to call you”. Again a bunch of bull shit. This guy has NO CUSTOMER service skills. I asked a simple question about a question on the form and this asshole goes off the deep end yelling at me and every time I tried to say something he screams telling me I won’t let him finish. When you pause in a conversation YOU ARE DONE TALKING. So he gets butt hurt when I refuse to allow him to talk to me like he was and called him a whine ass. This gets me over to Andrew, obviously a supervisor. He also won’t let me get a word in and keeps telling me that I won’t let him finish. Now all of a sudden they tell me they didn’t accept the first IDR form I sent back in Feb because I wrote “$300 per month” on the form. Just a bunch of excuses and no help. This place is nothing more than a bunch of bullies. I will be finding out what can be done to this business.

I received a “Notice Prior To Wage Withholdig” on March 26th. 2019 from F.H. Cann & Associates, Inc dated March 19th. I called them this morning at 9:16 central time with no answer. I called them back at 2:28 pm, and was disconnected the first attempt, so I called back. This time someone by the name of Rob answered. I asked him what his last name was but couldn’t understand what he said. He did however tell me that my representative’s name was John Diaz. I asked Rob to transfer me, and he said he tried but that he was unable to do so on the number I called on. (the main and only number that is on the letter) He said that John was going to try to call me while I was on the phone with Rob, my phone beeped, but there was no incoming call notification to switch over. I heard the beep twice. Then Rob said that he’d hang up so John Diaz’s call would go through. Here’s the irony, it’s now 3:36pm, I have yet to actually speak with “John Diaz” and to be honest I do not feel comfortable with this “legit company “ having any access to my paycheck or checking account, as this feels more like a scam than an actual legal business.

    Hello,
I have been contacted by FHC recently asking for a signed copy of my 1040. I found it odd that they requested that, instead of W2, considering 1040’s are for self employed individuals. I do not have any agreements with FHC, and any assistance with this process is greatly appreciated. Thank you.

I received a call from 6783694655 (a male) claiming to be with the US Department of Education asking me for my last four digits of my Social Security Number or my date of birth. He wouldn’t give me the reason for the call until I gave him the information I asked. I called back using a texting app and the recording said FH Cann and associates.

  • Mark B

almost the exact situation mentioned above where FH CANN refused to email me the additional documentation and had received payments from me. my wages are now being garnished and they will not call me back even though I have left messages so I can at least find out how to make payments
