What is Consumer Portfolio Services – CPS?

Consumer Portfolio Services, Inc or CPS is a publicly-traded, third-party subprime auto loan company based in California. CPS has received consumer complaints alleging violations such as improper communication tactics and sharing of information. If you have been contacted by CPS, make sure you understand your rights before taking action.

According to the Better Business Bureau (BBB), Consumer Portfolio Services was founded and incorporated in 1991 in California. The BBB lists CPS as a consumer finance company and a collection agency. According to its website, CPS works “with thousands of franchised dealers nationwide to make vehicle ownership possible for everyone.” CPS“is committed to bringing dealers the most competitive subprime programs and financing options available.” The dealers CPS works have access to its “knowledgeable marketing representatives in the field that are skilled in executing all aspects of subprime finance…for maximizing profit and fast funding.” For car buyers, CPS, through its “direct to consumer division” New Roads Auto Loans (New Roads), “specializes in giving auto loans to people with credit problems.”

Consumer Portfolio Services website provides information for car dealers and information for car buyers. Their dealer pages inform site visitors that Consumer Portfolio Services has programs for franchised and independent dealers and that partnerships with auto dealers have made CPS “a leading subprime auto lender.” CPS also helps dealers “build a successful subprime operation” by providing training and support from CPS marketing representatives who “know the market” and know how to bring dealers “qualified leads”, to ask “customers the right questions to help dealers maximize approvals and profits” and to “get paid” on deals.The dealer FAQ page outlines CPS programs and informs site visitors that more information is available by contacting CPS.

The Consumer Portfolio Services website includes a customer portal and a link to the New Roads website, which assures site visitors that The New Roads website provides “car buying tips” and “credit basics” that include advice for car buyers to “get their financing in place before” shopping for a car if there are “credit problems” to avoid being “turned away, asked to add a co-signer, steered to a lesser car, or asked to come up with a very large down payment” by a dealer. The website also includes a payment calculator, online applications, and information about which cars to buy to reduce interest rates.

The Consumer Portfolio Services and New Roads websites do not provide a lot of detailed information about their business practices or compliance policies. They do include standard, legally mandated information about information privacy and security.

How many complaints are there against Consumer Portfolio Services – CPS?

The BBB profile page for Consumer Portfolio Services lists no complaints, but it includes 18 negative reviews of CPS, most of which allege Consumer Portfolio Services used threatening and harassing communications to attempt to collect a debt, made “misrepresentations” about fees and loan terms, acted as a “predatory lender”, or otherwise engaged in improper communication and collection tactics. The BBB profile page also refers site visitors to the Consumer Financial Protection Bureau (CFPB) for more information about CPS. CPS Since June 2012, the CFPB has received 385 complaints about CFBP. He indicated that the account status should be reported as “Repossessed-Closed” and that CPS is purposely decreasing his credit score.”

In August 2017, a complainant alleged that when he fell behind on his car payments due to unemployment, CPS called him 5-6 times a day and were “very rude and threatening.” He indicated that he had to “hang up the phone because one Consumer Portfolio Services caller would not” end the call unless the complainant gave him a checking account number. Once the complainant began working, he resumed making payments, but CPS repossessed his car while he was “catching up on the payments.” In addition, according to the complainant, Consumer Portfolio Services called two of his references and “told them both he was behind on my car payments” and harassed “one of his references to the point” that the individual “became upset.”

    CPS sent me a letter with a credit card saying that I could get an auto loan, however it was just a ploy to get my information and now have been calling up to 3 times a day for the last few months. I don’t even have any debt with an auto loan from them. They are not even on my credit report. I am not answering their calls because they were so crooked and deceptive to begin with. I have no idea why they are calling. They obviously have my address so why not explain in a letter what they actually want? This cannot be legal.

We’ve made multiple attempts to make our payment and they keep giving us excuses why they can’t accept our payment. We have no problem paying our bills every month.     These people are thieves. Do not use. My original amount financed was 13,300 for 60 months. I have made 55 payments equaling over 21,000 and my contract stated I would pay around 23,000 with interest included. My principal is over 7,000 and they are still charging interest. How is this legal? How can you get sent to jail for robbing someone in person but when a company does it then it’s ok? These people are con artist.

    This is the absolute worst company! I got my car in 2017 because I had to an first they like most companies do illegal shady crap like gave me a interest rate of 25% when come to find out the federal and state governments have a cap on interest rates that no companies actually adhere to cause most of us people do not know about any of the laws. The cap if I remember correctly is between 7-12% depending on the state. I don’t mind having to pay higher rate for my dumb mistakes but it should be fair, an LEGAL! The calls don’t get me started on the calls like jeez if your a minute past your due date they will hound you and when covid came they where like well too bad you better pay this car note, you don’t need food. I feel like I pay an pay for nothing. It’s a huge joke. And they are rude.

    So in 2015 I bought a Chevy Malibu an made all my payments on time for two years up until Alcoa my job had shut down I had to push back payments few months because I had no employment after they laid everyone off in mean time while this was going my fiancé hit a deer an insurance deemed the car to be total loss I had purchased gap insurance when initially buying the car but was told after the insurance paid their part that my gap insurance wouldn’t cover anything because I had to set back payments a few times due to loosing my job the insurance paid out their portion took the car an after we didn’t hear much of anything else about the car or from consumer portfolio it was on my credit report as charged off but other then that dead silence fast forward to two months ago when I received a letter from an attorney office Thomas an thomas I called the number an they said they wanted list of all my bills an asked what I could afford a month to pay. I just bought a home an have three kids an wife I’m only one that currently works an I told them I would be able to start paying $100-$150 comfortably that’s all I could do for now. Waited weeks to get response an I find out today they are demanding $500 a month but will settle with $425 a month until paid in full it’s like $8000 they want the car was totaled out I haven’t had it since 2017 I can’t afford $425 a month an have money to live off of how can these places do this ! Is there anything I can do ??? Anyone with help or advice on how to get this situation handled please please reach me truann06@gmail.com

    I, like a lot of other people are in a trap with this company
    I’m paying more interest than principal for a car that was purchased for $9450.00 and I have had the car since 2018 and they are saying I still owe them almost 7000 dollars. If you don’t have your payment in on the due date they are calling but I was told that I have a ten day grace period any one of the company reps told me me in a rude manner that if my payment is one day late they would continue to call. They make mistakes and sometimes calls even when your note has been paid
    Then car warranty telemarketers keep calling me almost on a daily basis about the car and I know they got my information from CPS and to top it off when the dealer first tried to get me financed through CPS, CPS denied me credit and I have the denial letter, then about 3 months later the dealer called me and said he had more vehicles and that CPS agreed to finance me which I had never applied a second time with them. I am at my wits end with this company!

    Consumer Portfolio Solution took my car this morning. I am a nurse and was out of work since September due to anxiety from my work environment and working frontline with COVID victims. I have lost many friends and coworkers to this disease. As of 3 weeks ago, I have returned to work. I got an email from Vanessa Dixon at CPS on Friday that she was looking to move my case for repossession. At 6:07 pm when I got a break I paid two months plus fees leaving December payment due. January is due on the 29th. I emailed Vanessa to confirm payment was made. I called CPS to inform them of my payment on Friday and Saturday nobody could assist me. This morning my car was repossessed??

    Can anyone fight these guys, I actually surrendered the car nearly 3 years ago because my x stated (verbally) she would take it and pay for it. She did not, I could not afford because she left me with our two sons. Now three years later I get a summons to court, trying to negotiate with them and they are not moving any lower than the principal amount, I was negotiating earlier this year with them and had them down to 8k-9k, I only could come up with 4k, talks ended, I have paid 27k towards the car, they sold the car for $5700, and I still owe 15k? How is this possible. Has anyone had any luck fighting these guys and actually winning. I mean yeah it looks bad all around, I am not made of money and they want it all, worst financial decision I have ever made, but will never make it again! Need help in Alabama!

    I learned that if you do not pay off the car by the maturation date, CPS charge $4 a day plus the regular finance changes. I also learned that the car I purchases was a flood car. The dealership claimed that it was not but I found out when I went to trade the car in that it had absolutely no value. My car was purchased at Ballwin, MO Volkswagen. I received all the paperwork and notifications from the DMV. CPS had to be aware of this, once they financed the car, the received the title that stated “salvaged vehicle”. CPS has been calling & harassing me and my family daily.

    This finance company is the worst, I really do not understand how they can legally operate when they are stealing money left and right. My car has been financed through them Since 2016.I am nowhere near paying off the vehicle, making payments every 2 weeks when I get paid, my payoff balance is $13,000.00. It seems like I am not paying nothing on my car but I have. They keep HARASSING me call me every day. “We understand with all that is going on this is what we can do for our customers that may be struggling.” Mind you, I work in healthcare. Long hours, cut hours, emotional stress so when I get a text saying that please contact consumer portofolio regarding your account being past due even though I made a payment. I call to ask a question on this company they hang up on you. You call back they hang up on you. Again they are very rude, discourteous and cannot treat a customer with respect. I call and speak to a manager. They act like they don’t care and that they have no respect for customers and that they would rather treat customers like lower than dirt rather than being courteous to them.

    I have had it with this company. I have been making payments on a car that I purchased in 2018 and I still am not halfway through this nightmare. The car is broken down at least 6 months out of the year and I can’t even trade it in because I am so far under water with this loan. My contract was supposed to be done in 2022 now I receive a statement that said 2023. What! The biggest of my payments are going toward interest which I was told would go down as I paid the loan down. They are not going down and I cannot afford to do this another 2 years and 3 months. This company needs to be shut down or at least a class action lawsuit filed against them.

    Hi I had a loan with CPS for a 2012 Nissan Sentra the loan was taken out in 2014 I don’t know how dealers are aloud to use them I paid the car for 4 years my loan was 6 years the loan was 13 thousand they never sent me anything telling me what I owed when I found out I owed 10 thousand still i was pissed I all ways put more to my my payments than I was suppose to did nothing for my credit and when I contacted the dealer and told them I wanted to be put with another company they said i had to stay with them i did try to pay turn the car in the problem was i got put in to a car so the Kelly blue book said the car was worth 9 thousand but I did not believe that because my car did not even have 100 thousand miles no body would take my car either so my car was taken and I’m disabled and have been with out a car since because I’m on disability now and don’t get much money to get a car this place repo my car because I asked them to drop my payment a little they would not and I was not behind either my car would not have been paid off at the 6.year loan

    Purchase my car in 2016, the loan balance was $23k. It’s June 2020 and the loan balance is $21k. Looking at my payment history payments were made and they were applied as interest payments only. Something is terribly wrong with this picture

    I see a lot of stories similar to mine. I was an idiot and surrendered my old car prior to the discharge of my BK7 back in 2015. I was so concerned that WF was going to repo it in the middle of the night that I chose to purchase a new car that I certainly didn’t need and absolutely couldn’t afford. The dealership advised me that CPS was the lender and I was quoted an astronomical interest rate (22-23%) and an offensive monthly payment ($564) but I felt like I had no other choice than to purchase this new car to make sure that I had transportation to and from work.

    Needless to say, with a payment that high, I’ve had fairly consistent issues making my payments on time. I pay them when I can, as often as I can, and always try to make payments before or on the due date. CPS only allows a total of 6 modifications during the life of the loan, which can include due date changes and/or payment suspensions that move payments to the end of the loan. I am currently behind and they keep calling me, sometimes 3x a day, leaving voicemails advising me to call them because they “can help me get current.” Every time I call and ask for help, they tell me that there’s nothing they can do until I catch up but I can’t catch up because I owe $2000+ in back payments, fees and late charges. I need to move my payment back from the beginning of the month to the 20th but I can’t until I’m caught up… and even when I am, I’ve already used my 6 loan modifications.

    $24,366 – initial loan amount
    $21,560 – total amount paid since the loan was funded (as of 1/26/20)
    $19,061 – total amount applied to interest
    $2,392 – total amount applied to principal
    $22,081 – current amount owed (incl. misc fees)

    I am, by no means, a financial expert but their math doesn’t seem right to me. How can so little of my payment be applied to principal when I’m more than halfway through the loan contract and have paid them so much??? Even if I had decent credit, I couldn’t refi my loan because it’s so far upside down!

    I have been making payments for years and the balance doesn’t seem to be going down much. I am concerned because the car is losing value. It’s all going to interest!! How can they get away with doing these kind of loans? If I am one day late for payment the calls start coming ! I don’t know what to do with this car loan anymore, I feel stuck!!

    I secured a loan from CPS in January of 2017 for $22,000. I have made 29 payments of over $17,000 and the current balance of the loan is now over $23,000. I have had about 4 months deferred due to hardships from health reasons. I still managed to make full monthly payments towards the loan. They are claiming that all of my payments since the first deferment have been applied to interest. How in America is this legal and possible. Over $17,000 has been applied to interest and approximately $1,000 to principle? They also claim that I am 3 months behind in payments. They constantly harass my references if my payment was 1 day late. They have contacted people that I don’t even associate with and harassed them as well. They constantly call my phone and I have explained to them that I can’t answer while working and when I call back the customer service representatives are rude, intimidating, and threatening. They send unreadable text messages to my phone, emails, and even have strangers leave notices on my front door. I never avoided them and all of my contact information was always current. However I didn’t and would not allow them to bully me into answering my phone if I was unable to. A payment was made and it was short by about $100 due to my hardship and they told me to borrow money from family or friends. They repossessed the car and told me that I couldn’t attempt to recover the car and pay the amount required to get it released until 3-4 days later. I asked if I could get my medication, at least, out of my vehicle and I was told that I had to pay $35 and couldn’t get it until a week later after it was repossessed. This company is a predatory lender being operated by thugs. This is the worst company that I have ever dealt with. I was going to pay the amount required to get the car back but after reading the reviews and finally seeing that I am not the only person that all of the things that I have mentioned has happened to. This has to be illegal. They even ran my credit several times without my knowledge or consent.

    Consumer Portfolio Services trapped us in a repossession because they would not accept our weekly payments (was never an issue before). Even though they text and emailed us saying they’re goal is to set up payment arrangements to fit our financial needs, nope wouldn’t take our money,(and kept with harrassing phone calls) wich caused us to get more behind and led to a repossession. Claiming we would have to pay over $2,600 plus repossession fee of $370 to get the car back by the 21st of October, before it goes to auction.

    There interest rate is like 22 percent…. All my payments have been toward interest ND the car was only valued at 10000 when i got it in 2017 but my overall pay out amount was almost 17000 I still owe 15500 they say I have close to 1000 in late payment and daily interest fees from late payments etc… I wish I could give this car back it’s only worth like 6000 at the most I can’t trade it or anything

    Consumer Portfolio Service(CPS) are absolute crooks my original auto loan was for 10,995.00 and my contract was to be paid in full in February 2020, needless to say now CPS claims I owe them over 22,000.00 and when I ask for explanation and my original contract I get a contract that was not signed by me(fake contract) needless to say this company is a big fraud and I wish I would have never done business with these people.

    I financed a vehicle for 21,155.10 in 2014. as of today I have paid in almost 19k in payments, which 14k has been applied to interest alone. They are claiming I owe 18k as my balance. this would make my car loan be 30k plus. after incessant phone calls to myself and everyone I know in my family and friends, they are threatening to repossess the car. I will gladly give them the car back after almost 5 years of wear on it, but I will not give this company a single red cent more!!

    Consumer – Portfolio – Services “CPS” – legal department just explained to me that at any point, they have the right to run our credit (a hard inquiry), because they decide to. They claim it is because we failed to accept the harassing calls from CPS, and also failed to return their calls where voicemails left for my husband and I never returned those calls.

    None of which is true, I speak with CPS at least 2-3 times a month, because they do call over and over. I am in contact with attorneys now regarding our rights being violated as CPS does not have the legal right to run my credit or my husband’s credit without first obtaining our permission to do so. The guy from the legal department tried to transfer me 3 times. I recorded him giving me multiple excuses as to why they ran his report, yet none of those were legal.

    Also, why not just apologize? I would have thanked him for doing the right thing, and requested they remove it from his report.

    Since that didn’t happen, I’m left to fight for our rights as consumers.

    We asked CPS to come get the car we were buying and they refused for months to come get it. The car stayed parked in our driveway for over five months. Every day we would get phone calls and we told them we could not afford the payments to please take the car. Finally my husband asked if we could take it back to the dealership. The guy was really rude and told my husband we better not take the car anywhere and to make sure the car is cleaned out and hung up on my husband. This is the rudest company ever. If anyone asked about CPS I would tell them that I would rather ride a bicycle than get a loan from them.

    My ex-husband and I financed a car through CPS in 2015, then in 2014 couldn’t afford the payments, so we did a voluntary repossession in the early summer of 2015. They then sold the vehicle for pennies on the dollar and stated we had a balance of $7000 owed after the vehicle was sold. They contact myself or my ex, or both of us at least every 1-3 days. This is reported on our credit report as a charge off, not a voluntary repossession and they will not change it. My ex has been making small payments when he can and has reduced the balance to apprx 5800, but they still refuse to change our credit report to the correct info.

    I notified CPS in May 2014 that I had lost my job and could not make payments and requested a voluntary repossession. CPS refused and said it was not in their best interest to come and get the car. For one year the car sat in my driveway with daily calls (robo calling my cell phone ) from CPS. Finally more than a year later (with the value of the vehicle having dropped significantly.) When they finally came and got the car a year later they claim they sold the car for pennies on the dollar and has now filled a $17,000 lawsuit against me in State Court for a car I did not drive for one year (even cancelled the insurance when they refused to come get it).
