Comenity Bank, Comenity Capital Bank, or Comenity LLC is a financial services company which receives a lot of consumer complaints to our law firm for debt harassment. Find out who they are, why they might be calling, and how you can stop them.

Who is Comenity Bank?

Comenity Bank offers consumer credit through a variety of retailers and well-known companies. Comenity Bank’s in-house collections and billing departments have received a number of consumer complaints alleging financial crimes. If you have been contacted by Comenity Bank, Comenity Capital Bank, or Comenity LLC, make sure you know your rights before responding.

According to the Better Business Bureau, Comenity Bank has been in business 29 years and was founded in 1989. Their website boasts of connecting an astounding fifty million cardmembers with over one hundred of their favorite retailers, including well-known brands such as Victoria’s Secret, Pottery Barn, and Abercrombie.

According to their website, the most important thing Comenity Bank does is “providing each of our 50 million cardmembers with the highest standards of service,” with their “award-winning Care Center representatives.” Yet according to the Better Business Bureau, Comenity Bank “has failed to resolve underlying causes of a pattern of complaints.”

Comenity Bank offers credit cards through a variety of well-known retailers. Their website assures clients that their accounts are secure and that fraud complaints are investigated and quickly resolved. They offer a variety of convenient payment methods, including at the register of the store issuing the card.

How Many Complaints are there against Comenity Bank?

Since June 2015, the Consumer Financial Protection Bureau (CFPB) has logged over 649,546 complaints against Comenity Bank, ranging from attempting to collect a debt not owed to false statements and representation to refusing to resolve a problem with a return or transfer. The BBB’s profile page for Comenity Bank lists 1939 complaints from the last three years,with 847 closed over the last twelve months. Nearly all (1537) complaints were related to billing/collection issues, with a significant portion (369) related to problems with product/service. Of the 396 customer reviews, 381 are negative. Justia lists at least 24 cases of civil litigation that name Comenity Bank as a defendant.

How Much Does It Cost To File A Lawsuit Against Comenity Bank?

In 2017, in Pennsylvania District Court, Plaintiff “Renee B” filed a complaint against Comenity Bank alleging their collection practices violated the TCPA(Telephone Consumer Protection Act), which limits the use of robocalls and automatic dialing systems employing recorded messages. According to Comenity Bank, the plaintiff consented to these calls when she signed the credit card agreement. However, the calls continued after Plaintiff contacted customer service rescinding permission. Plaintiff was seeking up to $1500 per call. In June 2018, the case settled for an undisclosed amount following arbitration.

In 2012, a class action lawsuit titled Couser v Comenity Bank was filed in the Southern District of California court also alleging violations of the TCPA. Plaintiff was receiving up to four daily robocalls from Comenity Bank regarding a debt owed by her mother. Plaintiff informed Comenity Bank they had the wrong number and asked them to stop calling her on numerous occasions, to no avail. In her complaint, Plaintiff stated that she does not owe a debt to Comenity Bank, nor under any circumstances did she give them her phone number or permission to contact her. This class action was settled by Comenity Bank for an as yet undisclosed amount.

Understanding Your TCPA Rights

The federal Telephone Consumer Protection Act (TCPA) is a law that prohibits telemarketers, banks, debt collectors, and other companies from using an autodialer or robocalls to call you either at home, or on your cell phone without your consent.

The rules of the TCPA and of the Fair Debt Collection Practices Act (FDCPA), administered by the Federal Trade Commission (FTC), control telephonic collection practices. The federal Consumer Financial Protection Bureau (CFPB) enforces the rules and regulations of both Acts.

These laws also provide individuals with a means to seek monetary damages in court. For instance, the TCPA provides monetary compensation to consumers who can prove harassment. In the case of willful harassment, this compensation can be increased three times. As a result, entities can be fined up to $500 if case harassment is proved. In case willful violation is proved, this compensation can be up to $1500.

These robocalls are prohibited:

  • Calls made without your prior written consent to the business
  • Calls to a residential line listed on the “Do-Not-Call Registry”

  • Calls that do not provide the name of the caller, identify the business behind the call and provide a contact phone number or address
  • Calls that do not provide an automatic opt-out mechanism
  • Calls that violate the law, such as making misrepresentations or threats

  • A silent pause between when you answer the call and when the caller begins to speak
  • An audible click just after you answer the call
  • A prerecorded message instead of a live person on the other end
  • A hang-up after you answer

To prepare for a TCPA lawsuit, there are certain steps you can take to strengthen your case:

  • For each suspected robocall, make a note of the date and time of the call, the caller’s name, and their contact information.
  • Describe the contents of any prerecorded message, or of the conversation you had if you spoke to a live representative.
  • Save copies of any relevant cell phone call logs, voicemails, text messages, and cell phone bills.
  • Keep a copy of any letter or online contact you send to the caller that asks them to stop calling.

    I paid off my Comenity – Talbot’s account. I have a $0 balance. After paying off the account, they decreased my credit limit from $3480 to $100 and reported that to the credit agencies. That caused my credit score to decrease by multiple points after I was doing the responsible thing to decrease my credit usage. They tried blaming the change in my credit score as the reason they decreased my limit. I’m pissed off that they did this when I was being responsible. I tried to resolve it with them, but they just blamed me for their actions.

    Had a Forever 21 card with Comenity, after they charged me astronomical fees for a $20 purchase I chose to pay it off and close the account just to be rid of the hassle, well after it was paid and closed I receive a past due notice in my email, I asked what this is for and they said that a $3.33 service fee was charged the same day I closed the account, I have a correspondence from a representative confirming that the account was close and the balance was $0, and they have one excuse after another of why I still owe them money, well now they have the total due with late fees up to $174 and are destroying my credit, what can be done to stop this! I am at my wits end with them, they call non stop all day

    these people have greater horror stories with comenity than myself. I had some fraud occur with my card this year and it finally got credited back to me. then it happened again that they said I owed $30 because the fraudulant merchant had sent money back to my account so I was credited twice they said for $30 and then they actually mailed me a $30 check for whatever reason, and then they wanted the $30 back from me, and charged late charges on top of that. I gave them the benefit of the doubt and paid the $30 returning in essense the $30 snail mailed to me. thought that was it. today I see they are trying to bill me for $2. don’t know what thats for. my card is purposefully locked. I had a reward sitting on their website for 2.50. so I went in and asked for a credit to my $2 account statement and they took it, and said wait up to 5 days to see the credit applied. so ok. but I want to close the account and you can’t do that online. when you send a secure msg they usually respond by form that I should call them. when you call them you are waiting. when you finally get a rep they can’t help you. so I’m closing the account by snail mail and blocking any other correspondance with this company as obviously, their book keeping is messed up and customer service is very bad and they have thousands of complaints and lawsuits going on.

    Relentless harassing calls from Comenity Bank and I have no credit card nor conducted any business with this organization in my life! They are unprofessional in their messaging, despite the fact that the person they are asking for or to ‘work with’ is unknown to me – the owner of the cell number. They offer no excuse for their ignorance, lack of due diligence, and predatory activity aimed at someone other than me. I will join a lawsuit for the principle to stop such ridiculous behavior by this entity. These vultures must be stopped. I will donate any claim of damages to an entity fighting against this unlawful behavior.

    Today March 25, 2022 I get a phone call from Comenity Bank at 4:29 pm. The girl stated that my payment was past due. She took me by surprise and I told her what do you mean I haven’t received a bill yet. How can I be late? She said it was due in March 16, 2022. Well I told her that last closing date bill I got was Feb 18, 2022 and there was zero due. She kept insisting I was late. I made a purchase in March 7, 2022. So I paid over the phone. So the more I thought about the more pissed off I got. I pulled out the Feb closing date bill again and there was zero due. So I called tonight and got this guy, kinda rude and didn’t give two cents on their practice of lying. I explained to him about the previous call I
    received. And he too said I was late. I said no I’m
    late there was zero due. I then told him how can I be late paying when I have not received the bill yet? He admitted the bill was mailed in March 21, 2022. So I told him so you are admitting the bill went out on March 21 so how can I be late he said well because when you made your last purchase on March 7, 2022 and it was between February 18 and March 16 so you are behind. I said but that will be on the bill coming up, so it’s not due until April 16 he said no it’s past due. OMG these idiots. So this is what they are stooping to now, calling patrons and making them pay even before you get a bill. This has to be against the laws. I never even authorized them to call me. If this type of practice is operated in every bank and business they would be out if business for doing this. I have never in my life had a credit card company or bank tell me because my purchase was between the closing and due date I’m behind. How asinine and they need to be sued for this because apparently they are starting this practice of calling you and insisting you are past due when you have not received a bill and then taboot they admit it was just mailed. I want to sue so bad just for the moral purpose of this. They flat out lied. FYI I’ve had the VS card for years but they changed to this outfit and I just cancelled the card.

    I am another victim of Comenity Bank’s malicious consumer abuse debt collection scheme. I opened a store credit card with J Crew back in July 2021. I fully paid the statement balance after receiving their bill. It is February 2022 and Comenity J Crew continues to send me billing statements that consists of penalty fees. They deny having received any payment from my bank (as I paid using online bill pay), despite my bank having complied by sending them (Comenity) a copy of their electronic payment, including when this was cashed. Comenity did acknowledge receipt of payment on 1/20/22, stating further that they had credited the amount to my account. Yet they continue to bill me way more than the original amount that was owed and already paid by me 6 months ago. Anyway, the original amount was for $162.05 and now it has grown to $285. This company has to be sued big time and needs to be shut down because of their blatant criminal behavior scamming and bullying innocent and unsuspecting consumers like me. This is how Comenity Bank continues to stay in business as they enrich themselves with their shady unconscionable and malicious collection practices.

    Fed up. They overcharge in fees last few years and I have contested to no avail. The final kicker is today. I got an email so I visit the app to see what is up and they are dropping long time account through Talbots from $2800 to $800 which I have had for years. I have missed one payment on this account of $34 yet they are basing it on all of my various accounts which are taking it due to a work related pandemic issue. So now I am being punished so it will look like I have over 75% credit usage on my account when earlier this week I was under 25%. I am livid and not sure what I can do.

    Comenity bank has Not handled my dispute(s) for over a yr. now, citing covid 19, and they have added late fees and interest charges and interest on the interest charges . I have paid everything on the card except the disputed amount as the back of their own statement says NOT to pay the disputed amount in full but their customer service reps. say you have to pay it and then it will be refunded later IF they find ind ” your favor”..HA! fat chance..they just want to enrich themselves at the customer’s expense instead of doing what they promised in their agreements to go after the merchants when the merchant doesn’t give the refunds for poor quality items returned etc. Now after a yr. they want me to return produce that was moldy and (I was told by comenity cust. serv. reps. to throw it out instead of keeping but I supplied pics of the trash a yr. ago) and comenity is still refusing to do what they promised. They gave a conditional credit but then reversed the credit and charged it back to me on some items and refused to do the rest of the items that went uncredited because of merchants’ change of policies to refund or in 1 case where the merchant changed policy and went bankrupt and closed their doors ..In short comenity is constantly falsely reporting me as late to the credit bureaus and ruining my credit score and tacking on extra fees even though there was/is an open dispute, and they also lied about closing out the dispute and letters they say they sent but the first notification was received 1/15/2021 which was a copy of 2 letters they sent dated 12/8/2020 after I called and emailed several times and was constantly told they were” working on it..” and that no resolution was found in any notes (cust. serv told me in calls). They need to be stopped with these shady practices!! ….. no clue as to what the star rating is for above….

    Comenity is as fraudulent as they come. I signed up for a long time valued Kay Jewelers in July 2017 and upgraded my wifes ring for our 10th wedding anniversary. I was pleased with the purchase and I paid online as needed to remain current.

    Then all of a sudden this company buys Kay revamps the website leaving no ability to pay online leaving the only ability to pay was over the phone. They called from random numbers with no business name. I went into Kay & they apologized but assured me the site would be back up after routine maintenance as they update the member files.

    They never told me that I was transferred to another company who went by a variation of names SJI / Comenity Bank / Comenity LLC / AD Comenity / Kay Jewelers. This company & its representatives were impossible to deal with. I had a rotator cuff injury which placed me in a difficult financial situation so I ask them to give me time to pay later. They agreed & went behind my back demanding a payment a week later. They started attacking my credit worthiness & damaging my Credit Reports with lates.

    Fast Forward they finally sent my account over to Portfolio Recovery who hired the Law Firm of Weber & Olcese. We set up an agreement to pay off the entirety of the loan & delete the derogatories from my Credit Profile. Seemed like a win Right???

    No SJI / Comenity / Kay Jewelers or AD/ Comenity / Kay Jewelers have been inaccurately reporting a collection on that fraudulent account stating I owed a highest balance of $44k, I’ve disputed this asked for Validation & disputed for inaccuracies to no avail. It comes back showing that I had a highest balance of $11,600 when my limit with Kay Jewelers was never over my limit of $7000.00. The highest I’ve ever charged at any given time was $6401!!! They refuse to fix the inaccuracy or delete the entry all together. 
    More importantly I saw that others experienced the same bait & switch of credit and had a class action lawsuit against them for the inability of warning it’s customers of issuing new credit cards without our permission. Can You Help in either one of these matters????

    The customer service representative was unprofessional. I asked to speak with someone who has less of an accent so that I could completely clear up my bill issues. The representative told me that he knew I could clearly understand him and that he was the best person to help me with my concerns. He clearly didn’t listen I had to tell him I would conduct my business at the store to avoid further confusion and animosity. I was livid with the customer care. I had called back to get someone else and they couldn’t speak English clearly either and asked to be transferred to another representative. I was put on hold for over 35 minutes. All for clearing up a 30.00 late fee for a $1.00 balance on my Torrid card. I will be canceling my card immediately.

    Comenity Bank LLC has been calling me nonstop for weeks. I answered it at first and they had a prerecorded message telling me to contact them to try to get relief if I was affected by Covid. I haven’t answered any for a long time and in fact block every number they use. However, they use a new number every 3 calls or so, and I get at least 7 calls a day. Today they’ve called 4 times in the last two hours and it’s not even noon yet! The leave voice messages, even if the number is blocked somehow, which is usually someone breathing who then hangs up, silence, or a robot part way through some scam message. I do not have any outstanding credit cards and haven’t signed up for a new card in a long time. I don’t know why this started and I want it to stop.

    This company is absolutely terrible. I used a promotion on their Room Place credit card. They gave me a payment due date that was 7 days later than the promotional end date. A slight overlook on my part. I had set up paperless billing and automatic payments so I did not realize that issue until I received another bill for the following month. The interest charge was almost $300. I apologized for the oversight and asked if they could waive the fee, but I was told they would not do it. I have been a loyal customer for several years and have always made my payments on time. Here is an opportunity for them to show loyal consideration and mercy to their customer and they out right refused to help. I would NOT recommend anyone use this company and I will no longer use their card again.

    I had a late partial payment owed to comenity bank and they called me unknown and no caller id leaving messages like escalated matter on my voicemail. over like a $30 late payment. probably called 12 tumes in 6 hours

    Comenity has been calling my home and spouse non stop leaving messages for me. I’m not even sure how they got these numbers. They call all day several times a day from 7 am in the morning to 11 pm at night, they even call on the weekends as well and the last rep that called my and spouse on his cell left a message threatening me with jail time.

    My story begins, I defaulted on a credit card, that was through Comenity bank in 2001. I learned in 2008 I had a collection agency handling the defaulted credit card. I made restitution and restored my credit. After a few years, I opened a Kohl’s and Ulta credit card. I didn’t realize those two cards were represented by Comenity bank. It’s then I noticed with every purchase from Kohl’s and Ulta, I wasn’t recieving my credit card statements in the mail. Is Comenity trying to trip up customers in hopes they will have to pay a late fee? Hmmmm? I WILL NOT use Kohl’s or Ulta credit card from now on. Shame On Them!! I might had been wrong a long time ago, but they are the ones in the wrong! Cut up your cards and pay full dept. store prices. Not worth the trap.

    I had taken advantage of their account assure protection (2015) and when I tried to use it they told me I did not have it (Not sure what happened to the paperwork). So I had to take it out again and they charged me monthly to use this service and when you go to cancel, they give you a hard time. My monthly payments are sometimes 500.00 and when I question it, I am just told that is how it is. My card was kept by the store accidently, so I requested a new one from Comenity Bank. Every month for 6 months I had to call to find out where my card was and I was told that it was sent. Finally, I had to write the store directly and have them get my new card for me. When I would go into the store, the employees could not even look up my account by my name and address or social security number as Comenity had the account so screwed up (it was a joint account with my mom who passed away in October), they had my social security number incorrect among other things. I even sent them the information to correct it and I do not believe it is corrected as of yet. Comenity Bank’s customer service representatives are rude, they do not know what they are doing, most do not speak English well enough to understand them and if you are a day late they call you 10x that day to get you to pay the bill. Worst company around. Unfortunately, many of my cards are with them. I do not use any other cards that belong to them. This one is stagnant and I am just paying it off.

    deceptive practice/ added fees
    I went online to pay off the balance and close the account. I paid it off in full. A month later I get a statement saying i owe them $73 in finance charges and late fees. Spent 40 min on the phone with a representative, then supervisor and then account manager. Won’t drop the charges…

    Help me!I just made a deal with a devil !They charge me more than $1,500 fiance charge for a 2 day late payment!!! When I call them they said it was wright in the agreement and it can not be waived! Who check those agreement?They even didn’t give me a alert about this charge and they are waiting for my late payment!!!! They said as long as I pay the minimum balance for this $1,500 every month I will not get any additional charge any more.BUT! I still get finance charges every month !!!!!!!They know nobody check the agreement and add on devil items! Can I sue them in this circumstance? What should I do? If any body wanna take class action, please contact me!

    On the phone with Comenity Bank as I type this. I had the call escalated to a senior executive. My card was an Eddie Bauer which I paid timely from each statement, in most cases paying the balance off. I did not receive a statement for April and in May I did get one and I had a balance of $62.00. In addition, they assessed a late fee of $26.00. I told the young lady on the phone I would pay the $62.00 over the phone but I would not pay the late fee. I told her to cancel my card and write off the late fee.

    They cancelled my card as requested but failed to delete the late fee. In June I received a statement swing the 26.00 late fee, a $1.00 interest charge on the late fee and another late fee. They now say I owe them $56.00. I explained that 1. you cannot assess interest on a late fee and 2. you cannot add a late fee to another late fee as that is compounding. I was told they could not delete the late fee because the account is closed and although they should have deleted the late fee, they can’t now. I wanted to know how they could not delete a late fee but add another one plus interest if it is closed; they had no answer. I am on hold right now waiting to speak with a higher up to see if they can get this resolved.

    I am a Certified Expert Witness in Commercial and Consumer Credit and told them even though this is s small amount, I will take this matter all the way through to civil action if necessary and report this to the FTC, both in violation of compounding, illegal interest charges and violation of the FDCPA. Someone has to stand up to them. I told them if this is reported into my credit file, I would double down and sue them for actual and punitive damages for violating the Fair Credit Reporting Act (FCRA). Have now been on hold for over 30 minutes.

    I have received 2 phone calls in the last 3 months stating I owed money, also stating that if I do not have attorney to help with this problem. First I never of heard of this bank nor do I have ever gotten a credit card out it. It has non stop harrassment.

    I was late on a bill and called them to pay over the phone. I requested if they can waive the late fee and penalty and told them it is important for me not to have any late payment on my record since I was purchasing a house. The Customer Service person agreed to waived the late fee and penalty since it was my 1st time. Thinking that was resolved since I never purchase anything after that, I received a statement that shows a balance again for a late fee and penalty. I called them and was told that because I called after the due date last time, I was being charged for that eventhough there is no purchases and they never mentioned anything during that call. Since I am concerned about my credit and this Customer Service Person was obnoxious, I went ahead and paid the late fee and penalty I thought that was it, but I got another statement again with a late fee and a penalty fee. I have had it with Comenity/Overstock. They are leeching off of people like me and I refuse to be taken advantaged of. I am writing them a letter and copying the BBB, FTC, CFPB, CA State Attorney General’s Office and hoping a law firm will file a class action lawsuit against them for this type of practices.

    I have a HSN card that goes through Comenity bank. I have received over 300 calls since the beginning of November from numerous numbers. They even called me on my Facebook messenger. I was on a hardship program due to being disabled. What are my options? That’s not to exclude hundreds of emails. I’m fed up! I’ve been very sick for about 6 months. They have literally stressed me out.

    I had a Mandee store card through Comenity Bank for over 5 years and have paid on time for all of those 5 years, I have gotten numerous credit increases because of my on time payments. A few months ago, I went to the store to get a few outfits and get to the register, I am all tallied up and she tells me they no longer take the Mandee’s card. How ludicrous, how don’t you take your own store card. To add insult to injury, They have ruined my credit stating that I haven’t paid in 120 days. I just did the dispute. I have never paid late so I am really interested in getting a class action suit going. I either pay online or in person at the store. This bank is shifty at best and I won’t sit back and let this ruin my credit. I worked to hard to build myself up to have them try to tear me down. This is horrible business practice.     Comenity called my adult son two days after I made a payment. They left a voicemail indicating the debt had escalated…and added additional confidential information that was against FDCA. They’ve called me so many times, and I’m making payments each month on the debt (I have email receipts and bank statements).

    I believe that Comenity is doing other unsavory practices. The will often do inquiries on your credit and then drop your credit line after creating an order or making a purchase or making a large payment on your credit card. Each time they do this it drops a persons credit score and causes a chain reaction with other credit cards.
