Martinez v. Volkswagen Group of America, Inc.
Case Information

- Case Status: Case in Progress
- Court: United States District Court, District of New Jersey
- Filed: January 8, 2025
Lemberg Law seeks to represent a putative class led by Maria Lydia Martinez in a lawsuit against Volkswagen Group of America, Inc. The lawsuit alleges that certain 2022-2023 Volkswagen Tiguan vehicles are equipped with defective EA888 2.0-liter TSI engines that consume excessive amounts of oil between scheduled maintenance, creating significant safety concerns and financial burdens for owners.
Complaint
The complaint alleges that the EA888 engine suffers from a defect, commonly referred to as the Tiguan Oil Consumption issue, where faulty piston rings allow excessive oil to burn off in the combustion chamber. This Oil Consumption Defect forces owners to frequently add oil between scheduled changes to prevent catastrophic engine failure.
Key Allegations Include:
- Excessive Oil Consumption: Owners report needing additional quarts of oil every 2,000-3,000 miles, far more than industry norms.
- Potential Engine Failure: The defect reduces lubrication, increasing the risk of premature engine failure and sudden breakdowns while driving.
- Safety Risks: The unpredictability of the defect creates hazards, as drivers may experience engine failure at high speeds or in hazardous conditions.
- Manufacturer Concealment: Volkswagen allegedly knew about the defect prior to selling these vehicles and failed to disclose it to consumers.
- Failed Repairs: VW dealerships routinely dismiss consumer complaints, telling owners that excessive oil consumption is “normal” rather than providing a lasting fix.
Manufacturer Response
Despite years of consumer complaints, Technical Service Bulletins (TSBs) issued by Volkswagen, and numerous National Highway Traffic Safety Administration (NHTSA) complaints, Volkswagen has not issued a recall or provided an effective repair. Instead, dealerships reportedly instruct customers to continuously add oil, leaving them to bear the financial burden.
Claims for Relief
The plaintiffs are seeking:
- Repairs: A free and effective fix for all affected vehicles.
- Compensation: Reimbursement for repair costs, diminished vehicle value, and additional oil purchases.
- Injunctive Relief: A requirement for Volkswagen to issue recalls and properly inform affected owners.
- Punitive Damages: To hold Volkswagen accountable for knowingly selling defective vehicles.
