Autumn Chamberlain has filed a class action lawsuit against NRA Group, LLC, operating as the National Recovery Agency (NRA), for violations of the Fair Debt Collection Practices Act (FDCPA). The lawsuit focuses on NRA’s repeated debt collection text messages sent to consumers after they replied “STOP,” requesting no further communication. Despite assurances that no additional messages would be sent, the NRA continued its communication, leading to claims of privacy invasion, frustration, and other damages.
The Complaint
The complaint highlights a systematic practice where the NRA sends multiple debt collection texts to individuals even after clear written requests to cease communication. Upon receiving a “STOP” message, the NRA would confirm unsubscription but would continue sending messages. These actions directly violate the FDCPA’s provisions, which mandate that once a consumer requests a stop in communication, collectors must comply unless under specified circumstances.
The class comprises individuals across the U.S. who experienced similar conduct from the NRA, making this issue widespread. Plaintiffs allege the following:
- Messages were near-identical and continued after clear opt-out requests.
- Consumers experienced frustration, time waste, and unwarranted invasions of privacy.
- Communication persisted despite NRA’s acknowledgment of their requests.
Class Certification Granted
The U.S. District Court has granted Chamberlain’s motion for class certification, allowing the case to proceed as a class action. The Court certified the following class: “All persons within the United States to whom NRA or its agent’s
and/or employee’s sent a debt collection text message between November 19, 2020 and February 16, 2021, after said person had previously messaged ‘STOP,’ ‘Stop’ or ‘stop’ to NRA.”
