A Summary of Your Rights Under the FCRA

You have a number of background check and disclosure rights. For example, an employer is required to obtain your written consent in order to conduct a background check. Once the employer receives the background check, they are required to inform you if they didn’t offer you a job or promotion because of the background check.

In fact, in order to obtain a background check company from Americheck, the employer must certify that a) they’ve given you a standalone document that indicates the employer may conduct a background check; b) that you have given your permission for them to obtain a background check; and c) if they take an adverse action based on your credit report, they will give you a copy and notify you of your FCRA rights.

Your Right to an Accurate and Legally-Compliant Report

Under the law, Americheck must take reasonable steps to ensure its report is as accurate as possible.

The Fair Credit Reporting Act curtails the types of negative information included in an employment background check report. For example, certain legal actions – such as civil lawsuits, arrest records, paid tax liens – can’t be included after seven years. The report can’t list expunged convictions, though it can list other criminal convictions, regardless of date. In addition, the report can’t include accounts being handled by debt collection agencies if they’re more than seven years old. If you’ve successfully completed bankruptcy proceedings, your bankruptcy can’t be included if it’s more than ten years old.

Your Right to Dispute Dispositions and Discrepancies on an Unfair Report from Americhek

If you weren’t hired or promoted because of your background check, the employer is required to provide you with a copy of the report. If you believe any of the information contained in your report is incorrect, you have the right to file a dispute with the background check company.
