Is Allied Trustee Services a scam?

They’re legit. Allied Trustee Services has been in the collections business for 26 years. The company was originally started on May 14th, 1994 and opened its Better Business Bureau account on July 19th, 2001. Allied Trustee Services has also not been accredited by the BBB and has additionally received a “D-” rating from the BBB. Though Allied Trustee Services has not received a glowing review from the BBB, the company’s years in service lend it its legitimacy. Therefore, the debt which you may have been contacted about is real, and needs to be dealt with. Though it is necessary to resolve this discrepancy, it is still possible that Allied Trustee Services may be in violation of the FDCPA.

While it is important that you do not ignore the need to resolve your alleged debt with Allied Trustee Services, as this could potentially harm your credit and ability to take out future loans, be wary of any suspicious activity where the company could potentially be violating the FDCPA.

According to the collection company’s website, Allied Trustee Services, “utilizes the most sophisticated technology and partners with the leading vendors in the default title and collection support industries”. The collections company claims that these assets provide the company with the ability to provide the most, “efficient, accurate, and successful” collection services. The company also states that Allied Trustee Services is a part of a variety of professional organizations, including, the United Trustees Association, CACM (California Association of Community Mangers), CAI (Community Associations Institute) and Echo (Executive Council of Homeowners).

Lastly, in regard to the collection company’s size, the company has an employee base of 24 people and sales of $5 million (according to zoominfo.com). The Allied Trustee Services website also lists the leadership of the company, which includes Director of Operations Gary Wisham, Director of Sales and Marketing Phillip Charest, General Counsel J. Albert Garcia, Josephine Harter, and Kari Fleshman (Bristow).

Who does Allied Trustee Services collect for?

Allied Trustee Services writes on its website that their company is a premier asset collection agent and non-judicial foreclosure trustee. The company further explains their services by writing, “We work closely with property management groups, community association boards and their members to resolve even their most difficult delinquent accounts.” Therefore, it is likely that your debt lies within one of these areas of collection mentioned on the Allied Trustee Services website.

However, it is still important that as a consumer you confirm with the collections company about what debt is specifically owed and to whom. Inquiring as soon as possible is the smartest move to make, and if you feel as though this company has breached their FDCPA rights be sure to contact an attorney to help you file a lawsuit. Allied Trustee Services also outlines their collections process on their website, explaining that they provide specific services for their clients which include, “Simplified Start-up, $1 Million Errors and Omissions Insurance Coverage, Legal Oversight and Supervision by In-House Counsel, and Highly Experienced Staff”.

Can you help me file a No Fee Lawsuit against Allied Trustee Services?

Absolutely. You can sue a debt collector. Here is a sample complaint:

A complainant asked for Allied Trustee Services to send the complainant verification of debt owed. The collections company instead send an account ledger, instead of, “proof of verification by signature”, claiming that a ledger is all that is required. The complainant feels as though this statement and refusal to send written verification is a, “clear violation of the Fair Credit Act”. The complainant explains that the collections company failed to provide ANY validity with ANY inquiry, in fact refusing to do so. Recently, the complainant has demanded again that verification of debt be provided,  and, “Allied Trustee Services continues to be in noncompliance”. The complainant believes that this violation awards them the ability to file a law suit for violating the Fair Debt Collection Practices Act.
